2 ADF Cases Play a Part in Trump’s Religious Freedom Order

For over 25 years, Alliance Defending Freedom has been fighting to protect the freedom of all Americans to live and work according to their faith. In commemoration of Religious Freedom Day last week, President Donald Trump announced an important step forward in upholding this first freedom.

On January 16, President Donald Trump made a proclamation celebrating Religious Freedom Day. Along with it, his administration released the package of proposed rules and guidance.

The guidance was issued through several federal agencies and provides information on legal protections for prayer and other religious expression in public schools. It also makes clear that faith-based groups do not lose their right to autonomy, expression, religious character, or independence from the government merely because they receive a federal grant.

The guidance is yet another example of the administration’s commitment to protect and rightly interpret the First Amendment, and the courage of Alliance Defending Freedom clients helped set the foundation for the latest policy advances.

The Wall Street Journal: New York Tries Again to Muzzle Pro-Life Groups

Backers of New York's so-called "boss bill" may claim it’s harmless, but The Wall Street Journal's Nicole Ault reveals it is anything but. In 2019, New York Gov. Andrew Cuomo signed a law that prohibits employers from making hiring or firing decisions based on "reproductive health decision making." In practice, that means that even pro-life pregnancy centers and churches would be forced to hire people who do not agree with their mission. As Ault writes, the National Institute of Family and Life Advocates (NIFLA)—joined by other pro-life organizations—have challenged the law with the help of Alliance Defending Freedom. Ault notes that in NIFLA v. Becerra, NIFLA and ADF successfully challenged a California law that forced pro-life pregnancy centers to advertise taxpayer-funded abortions, winning a U.S. Supreme Court victory in 2018. No matter what you think about abortion itself, Ault writes, no government should force nonprofits—let alone churches—to hire people who don’t agree with the very heart of their mission.

The Hill: Trump administration's religious freedom announcements square with Constitution, Supreme Court precedent

Last week, the Trump administration announced several rules advising federal agencies to respect the freedom of every American to peacefully live and work according to their faith. As Alliance Defending Freedom President, CEO, and General Counsel Michael Farris writes, these decisions fall in line with Supreme Court precedent and legally bolster the promise of religious freedom enshrined in the First Amendment. Farris highlights several examples where government officials have treated religious Americans as second-class citizens, and argues that the administration's moves will help prevent this type of religious discrimination. Farris also explains that the Establishment Clause—which limits what the government can do in either promoting or disparaging religion—also works to ensure that no American needs to live in fear of unjust government punishment because of their faith..

Has "cancel culture" claimed another victim? While writing for The Denver Post, columnist Jon Caldara commented on the current trend in Colorado politics to force teachers and students to adjust their speech to match what is currently acceptable to advocates of transgender ideology. One idea that Caldara defended was the fact that only two sexes exist. Because of this, Caldara claims he was fired from The Denver Post, similar to a story out of the United Kingdom in which a woman's contract was not renewed because of her outspoken belief about biological sex. Caldara says that people with differing viewpoints should not have their speech compelled and that free speech applies to everyone.

Sanctity of Life

USA Today: I was an abortionist. The abortion industry isn't willing to prioritize patient safety.

As thousands of Americans gather in Washington, D.C., for the March for Life, one former abortion practitioner explains why the pro-life movement is so crucial. Writing at USA Today, Kathi Aultman reveals that as she performed more and more abortions, she was faced with the reality of what she was doing: murdering children. She began to voice her concerns, but she increasingly realized that, despite the abortion industry's claim that it supports women's health, what it cares about most is making money. In fact, Aultman argues, abortion providers care more about dollars than patient safety—a reality highlighted in an upcoming U.S. Supreme Court case, June Medical Services v. Gee. There, it’s abortion practitioners—not women—who are challenging a necessary law that has already improved the health and safety of women. Aultman concludes that, while her journey led her to become pro-life, all Americans can at least agree that abortion practitioners should give women the same continuity of care as the law requires of other medical practitioners.
