New Association President Featured in Home Health Care News

 
News of Emma Dickison’s election as HCAOA President was covered by Home Health Care News. Turning to a previous interview with Dickison, reporter Joyce Famikinwa noted Dickison’s record of growth in the home care space.
 
 “The home care space is very dynamic — and it is changing,” Dickison previously told Home Health Home Care News. “We have been, I believe, a leader in those changes. Not just in franchising, but in home care. Our average growth rate over the last three years was 24%. We’ve outpaced the industry in that regard.”

First 2020 Fly-In Targets Ways and Means on March 3-4


During this year HCAOA will be hosting several “fly-in” events where members can participate to meet with key congressional offices on targeted subject matters.  The first of these will be on March 3-4, 2020; the focus for this fly-in will be the key Congressional Committees handling Medicare, Medicaid and tax related legislation.

Illinois Chapter

 
Illinois Chapter Discusses Tax Code, New Laws, and Minimum Wage Laws at January Meeting
 
The Illinois Chapter met yesterday and in Elmhurst and via teleconference. Patrick Cooney, HCAOA’s national lobbyist, kicked the meeting off with an update on federal legislative priorities for the Association, including the Credit for Caring Act, Immigration, and Medicare Advantage expansion. Cooney also noted that three Representatives from Illinois sit on the Ways and Means Committee, which will be a main focus of HCAOA’s March Fly-In. Conversation then moved to local laws, with David Ormsby guiding the assembled group through a review of Illinois laws that came into effect this year that have impact on the home care industry. Ormsby highlighted SB 1624, which requires companies to report data breaches that impact at least 500 Illinois residents, and SB 75, which makes numerous changes to employment and civil rights laws to ensure that workers who experience sexual harassment and discrimination have a meaningful remedy under Illinois law.

Nebraska Chapter Teams with Nebraska Home Care Association to Weigh in on Home Health Agency Regulations

 
On January 21, 2020, the HCAOA, in a joint letter with the Nebraska Home Care Association, provided detailed comments to the Nebraska Department of Health and Human Services regarding a proposed draft home health agency regulation. The draft HHS regulation would create significant disruption in home care operations and in seniors’ access to personal care services, by requiring home care providers to obtain a home health agency license in order to provide any kind of bathing services.
 
The HCAOA and the Nebraska Home Care Association outlined both the legal and practical issues with the proposal. At the same time, the two associations, reiterated their strong commitment to enhancing consumer protection and offered to help convene a stakeholder group to discuss appropriate training standards and oversight of personal care in the state. You can read the letter HERE. The HCAOA will continue to build coalitions whenever possible to advocate effectively on behalf of its members.

Ohio Chapter

 
Save the date for an HCAOA Ohio Town Hall meeting on Tuesday, February 25. The meeting will occur from 11 a.m. to 2 p.m. at Wesley Glen Retirement Community in Columbus, Ohio. HCAOA Executive Director Vicki Hoak will provide opening remarks and a report on the state of the industry.

Washington Chapter

For the past seven years the WA Home Care Association, Home Care Association of WA and the WA State Hospice and Palliative Care Organization have joined forces to meet with state legislators to discuss important issues for In-Home Services. We are all licensed under the Department of Health (DOH) In-Home Services program and in the real world, home health, hospice and home care agencies work cooperatively together all the time. Our associations typically have a very similar legislative agenda and legislators really appreciate the fact that we coordinate this day together instead of three different meetings! It’s also a fun way to get to know other in-homes services providers from around the state and in your region.

Congressional Update

House Moves to Pass Protections for Older Workers 

 
On January 14, 2020, the House of Representatives will consider for passage the Protecting Older Workers Against Discrimination Act (H.R.1230) . The bill effectively reverses a 2009 Supreme Court decision on age discrimination, specifying that unlawful age discrimination occurs when a worker demonstrates that age was a motivating factor for an adverse action, even if other factors were involved. 
 
Under that 2009 Supreme Court ruling, a worker must currently demonstrate that age discrimination was the only motivating factor for the adverse action. Democrats say the bill is necessary to restore protections for older workers and align the standard for establishing age discrimination with standards for discrimination against other protected classes. Republicans say the alleged need to reverse the 2009 Supreme Court decision is not evidence-based, given that the impact of the ruling has been neither researched nor measured. 

States Move Away from Health Care Exchange

As reported by Congressional Quarterly, at least four states are considering launching their own health insurance exchanges as the cost to use the federal HealthCare.gov website rises and enrollment declines. 

Maine, New Jersey, New Mexico and Pennsylvania are pursuing plans to take control of their exchange platforms as soon as next year, citing increased data and marketing capabilities in addition to potential budget savings.

CRS Releases Report on Long-Term Services and Supports

On December 30, 2019, the Congressional Research Service (CRS) updated its brief titled an “Overview of Long-Term Services and Supports.” The report can be found here and highlights the median cost of various long-term care support services (LTSS).

The report states that most LTSS is provided by non-licensed providers such as certified nurse assistants, home health aides, and personal care aides. The Bureau of Labor Statistics (BLS) estimated that there were 3.3 million home health aides and personal care aides in 2018. This likely underestimates the number of home care workers, as it does not include self-employed workers. 

Between 2018 and 2028, home health aides and personal care aides are projected to be among the top 20 fastest growing occupations, both in terms of rate of growth (a 36% increase) and numerical growth, with an increase of 1.2 million new jobs. This is faster than the average rate of growth for all occupations at 5%.
 

Congressional Corner

This week the House of Representatives is not in session but the Senate is in town to begin to hear the impeachment trial of President Donald Trump.

The House managers would be allotted up to 24 hours over the course of up to two days, starting Wednesday afternoon, to make the case that the president should be removed from office.
