Last week, we were contacted by Byron Council with updates to the proposed amendment to the Local Environmental Plan (LEP) for rural weddings and events in the Byron Shire.
 
The response to councils submission to the State Government was to remove RU1 and continue only with RU2, and to move the management criteria in to the Local development control plan (DCP)
 
The good news is that this means the matter will go to community engagement again.

In addition the DCP conditions are managed by council so should for whatever reason the criteria require amendment, our local council can implement changes more easily.
 
We would like to request that for anyone that is in RU1 and other areas, to contact council directly (Michelle Chapman 
MChapman@byron.nsw.gov.au)  with something in writing to state why they feel RU1 should not be exempt. 
 
The council have advised the amended planning proposal and new draft DCP Chapter D9, are on exhibition for four weeks until Friday 28 February 2020.  

You may recall a planning proposal was previously exhibited in late 2018.  It has been amended as a result of two changes determined by the NSW Department of Planning, Industry and Environment (DPIE) to:

- remove the reference to permitting rural events on land zoned RU1 Primary Production, (events would only be permitted on land zoned RU2 Rural Landscape); and
- remove many of the detailed provisions and include them within an amendment to the DCP.

The DPIE’s approval requires public exhibition of the amended Planning Proposal and a new DCP 2014 Chapter D9: Rural Event Sites.
