Negotiated Rulemaking Underway

BackgroundIn July 2018 the U.S. Department of Education delayed the effective date of the federal state authorization regulation until July 1, 2020. The intent of the delay was to allow time for a negotiated rulemaking committee to address concerns raised by stakeholders. 

Then, in December 2018, a federal judge allowed a lawsuit to continue which challenged the Department's delay of the regulation. Plaintiffs allege that the Department didn't follow the correct process to delay the rule. They also argue that students are being deprived of disclosure information they could be using to make enrollment decisions about online education programs.

UpdatesThe negotiated rulemaking committee and three topic-based subcommittees will began meeting on January 14, 2019. State authorization is one of several topics that will be discussed in the Distance Learning and Educational Innovation Subcommittee. The Department requested that committee members begin negotiations with the Department's redlined version of the regulation (scroll down to "materials handed out"), which eliminates the pending state authorization regulation. 

The committee must unanimously agree on a large number of topics impacting institutions that participate in federal financial aid programs. If the committee doesn't reach consensus on all topics, the Department will move forward with its own version of the regulations. Negotiations are scheduled to wrap up in March, and proposed regulations are expected to be released for public comment this summer.

Bottom LineHow will a new federal rule impact Ohio State's out-of-state activities? It's too early to tell what might be included — or excluded — from a new regulation. Until we learn more, remember that state regulations, NC-SARA policies and other federal regulations are currently in effect. The state authorization team will continue to seek and maintain compliance with those requirements and will monitor the status of evolving federal regulations.


NC-SARA Data Collection Reminder

If you received student placement data but have questions about the data review process, contact the state authorization team.

The state authorization team has received 95% of placement data to date. Outstanding data should be reviewed and returned to the team as soon as possible. Submission of this report to NC-SARA allows Ohio State to continue to enroll out-of-state students in online courses and to place students in out-of-state field experiences such as clinicals and internships. 

Thank you to all liaisons, data contacts, faculty and staff who have already reviewed and returned placement data. Ohio State would not be able to participate in the State Authorization Reciprocity Agreement (SARA) without your contribution to this university-wide effort.
