The Governor and State House leaders have come to an agreement on two key issues regarding legalization of adult-use cannabis – a flat tax rate and the make-up of the Cannabis Regulatory Commission.
Since the news broke late last week, many have eagerly pointed to this week’s voting session (Thursday, Feb. 21) as when the three bills – the New Jersey Cannabis Regulatory and Expungement Aid Modernization Act (S2703), the Jake Honig Compassionate Use Medical Cannabis Act (S10) and S3205, which revises certain procedures for expungement of records of conviction – could be voted on and passed. That is probably too optimistic.
The NJCIA has been very active – along with advocacy and industry experts – in helping to shape the conversation and offer solutions to the obstacles in enacting the laws.
We’re also realistic in that while the agreement on these two key issues is crucial, it is not all that needs to be done.
We expect that it is more likely the vote will take place in March, a sentiment echoed by Senator Nicholas Scutari in an interview with NBCNewYork.com on Monday.
That’s because there’s still much work to be accomplished, including:
- Securing the votes in the Senate and Assembly;
- Establishing a municipal tax rate that is acceptable to all parties;
- Nailing down the language and costs of the expungement bill.
We are confident this will get done. It’s been a long process – and everyone wants to get to the finish line as soon as possible. It’s vital that we make sure in our rush to get this done that what we’ve been fighting for as an organization and an industry remains the desired outcome. We need to continue to be thoughtful and resilient. We are on the precipice of making New Jersey the most progressive state in the country when it comes to the cannabis industry. We are cautiously optimistic that our years of work will soon be rewarded. And remember, once the bills are passed, the real work begins.

Our legislature is considering a cannabis legalization bill that includes significant provisions mandating the expungement of cannabis related criminal records and promoting meaningful avenues for broad minority participation in the legal cannabis industry. Criminal record expungements and minority business participation in the legal cannabis industry can’t make up for decades of social injustice — but it’s a necessary starting point. Our legislature is addressing these issues as part of carefully crafted, comprehensive cannabis legalization legislation that will deeply benefit the people of New Jersey.”

Nurture Legal Cannabis in the Garden State

New Jersey legislators will soon vote on comprehensive cannabis reform that will expand the medical program, legalize and regulate cannabis for those over the age of 21, and create an expungement program for people who have been convicted of certain marijuana related offenses.
The social justice, economic and public safety arguments for legalization have been well established, but the legislation needs to pass a full vote in both chambers of the New Jersey legislature and be signed by the governor before we can make meaningful progress to realizing the benefits.
Your elected officials need to hear from their constituents. They need to hear from YOU! They need to hear that there has been enough discussion and it is time to act!
