Sending a Graphic of Multiple Prospective Student-Athletes Privately to a Prospective Student-Athlete (I)

Division: I
Date Published: March 20, 2019
Item Ref:
Interpretation:

The committee determined that an institution may send an individual prospective student-athlete general correspondence that includes a graphic of multiple prospective student-athletes who have not committed to the institution. Sending this type of correspondence privately to a prospective student-athlete is considered general correspondence and, therefore, not subject to the legislation restricting public comment by an institution before commitment.

Case Summary:

Assistant Cross Country Coach had brief in-person off-campus contact with high school junior PSA. Coach was in attendance at the HS National Championships. PSA is a 2020 graduate competing in the event. He came up to the coach with his parents and initiated conversation. The interaction between PSA, coach, and parents lasted approximately 8 minutes. Coach realized only after the conversation that PSA was not contactable and self-reported to Head Coach, who was also in attendance. HC told Assistant to report to compliance immediately. Coach did not initiate conversation. Immediately self-reported.

Follow-up Action:

Rules education for Assistant Coach. Contact with the PSA was counted and remaining contacts were reduced by 1 in 2-for-1 penalty. Letter of admonishment for Assistant Coach.

Case Summary:

On November 14, 2018, a sports information staff member put out a press release that a PSA had signed prior to institution receiving the signed NLI. Sports Information released the field hockey recruiting class prior to confirming with compliance that all NLI's had been received and verified. On 11/14/18 in the late morning, the press release was sent. Institution received the valid NLI at 3:30 pm later that day. Sports Information person is an intern and this was her first experience with announcing NLIs. Of the teams she is assigned to cover, this was the only team with signees on the early signing date. The Assistant Athletic Director of Communications said he failed to remind her to check with compliance prior to releasing the class. All other NLI's were received prior to the release.

Follow-up Action:

Compliance office provided education to all sports information staff immediately. Compliance will remind all Sports Information staff annually prior to the early signing period to gain approval from Compliance prior to media release.

Case Summary:

On January 31, 2018, an assistant women's basketball coach (AC) used pictures of several of its student-athletes to promote its upcoming summer camps on social media. The advertisements were not approved by the Compliance Office in advance of their publication in accordance with department policy. The AC incorrectly believed that because SAs were seniors and their eligibility would be exhausted by the time of camp, it was permissible to use their photos to promote the camp. The violation was discovered the same day by the SID.

Follow-up Action:

(a) Self-report Level III violation (b) Post removed (c) Letter of admonishment to staff member involved as a result of NCAA violation and failure to adhere to institutional procedure (d) Rules education to staff member involved on camp advertisements as well as department policy on camps
