Family And Domestic Violence Leave - Updated Workplace Relations Handbook
Fair Work Commission (FWC) has handed down a decision regarding family and domestic violence leave in Awards. All Awards including the Registered and Licensed Clubs Award 2010 (Clubs Award) will now include an entitlement to five days of unpaid family and domestic violence leave.
This new provision is effective from the first full pay period on or after 1 August 2018. Clubs which are currently on an Enterprise Agreement will not be affected by the new provision.
Key details are as follows:
  • ‘Family and domestic violence’ means violent, threatening or other abusive behaviour by a family member of an employee that seeks to coerce or control the employee and that causes them harm or to be fearful.
  • All employees (full-time, part-time and casual) are entitled to five days’ unpaid leave each 12-month period to deal with family and domestic violence; the leave does not accumulate from year to year.
  • The reasons for which an employee may take leave include (but are not limited to) making arrangements for their safety or the safety of a family member (including relocation), attending urgent court hearings, or accessing police services.
  • Clubs may require an employee taking leave to provide evidence that would satisfy a reasonable person that the leave is taken for the purpose set out in the new provision. Depending on the circumstances such evidence may include a document issued by the police service, a court or a family violence support service, or a statutory declaration.
What does not-for-profit mean? This fact sheet covers the basics such as What is the difference between not-for-profit and for-profit organisations, and Why this distinction is important. For more information you can listen to this podcast.
All Incorporated Associations must have Schedule 1 Rules within their constitution prior to July 2019. Click here to check your constitution meets these requirements.
Don’t think you will get your new constitution/rules updated by 1st July? Don’t worry, you will not be fined!
It will just mean that where your rules are silent for Schedule 1 of the Act and/or contradict the Act, then the model rules from the Regulations will automatically apply to those sections only. Under the Act, you may also apply to the Commission for an extension.  If considering this, you will need to contact Consumer Protection directly. 1300 304 054  /  consumer@dmirs.wa.gov.au
