Kim's presentation addressed the potential liabilities of fire maintenance contractors. It is a very topical issue mindful of the serial dimension of fire calamity within the global context over the last few years.

Since July 2018 there has been a new system of corporate registration building practitioner companies in Victoria, meaning that the company itself becomes a registered building practitioner. This is a big departure because previously the registered building practitioner in these disciplines has always been the natural person individual. Justin Cotton discusses potential avenues for indemnifying directors against disciplinary findings and the potential for the use of 'danger money' to compensate for the risk that directors take on, where the company has a corporate registration. Also canvassed in this article are avenues to review decisions pertaining to fitness and propriety of directors.

Building practitioner advocacy is now an established area of the law in Australia, mindful of the fact that every jurisdiction has practitioner licensing regimes that have been in place for the better part of two decades. “Only a fool has himself as a client.” If this saying has any merit, it is very important that one can avail oneself of sound legal representation if one is called upon to account for conduct that is scrutinised by oversight bodies. Justin Cotton: 17 years of Construction Law Practice

Justin Cotton joined the firm in one of its previous incarnations in 2002. Justin has been with the firm for 17 years after having moved over from New Zealand. During his tenure as a construction lawyer, from junior to senior, he has developed an outstanding reputation as a leading construction lawyer. This is consistent with him having been appointed as Chairperson as the HIA Industrial Relations and Legal Services Committee. Justin is one of the rare practitioners that has conduct of matters on a cross-jurisdictional basis with a primary focus in Victoria, the ACT and New South Wales. Whether it be building practitioner advocacy, carriage of the resolution of complex building disputes, or occupational licensing, he has developed formidable expertise in all of the above.
