The regulations implementing the Indian Child Welfare Act provide that Indian Tribes may designate an agent other than the Tribal chairman for service of notice of proceedings under the Act. This notice includes the current list of designated Tribal agents for service of notice. Link here.



The Administration for Children and Families, U.S. Department of Health and Human Services, is hosting a Tribal Consultation on the Notice of Proposed Rulemaking (NPRM) on the Adoption and Foster Care Analysis and Reporting System (AFCARS), published in the Federal Register on April 19, 2019 (85 FR 16572). This page provides an overview of this consultation, which is scheduled for Monday, June 3, 2019 at the Marriot Pyramid Hotel in Albuquerque, NM from 10:00 a.m. - 12:00 p.m. MT.

Indian Child Welfare Act (ICWA): Implementation of AB 3176 for Indian Children

Summary: The Tribal Court–State Court Forum (forum) and the Family and Juvenile Law Advisory Committee recommend adopting a new rule of court, amending several other California Rules of Court, and revising several forms for Indian Child Welfare Act (ICWA) and juvenile court dependency proceedings to comply with statutory changes in Assembly Bill 3176 (Waldron; Stats. 2018, ch. 833) as well as changes to governing federal regulations and guidelines. The proposal also addresses technical amendments and corrections, and responds to several appellate court decisions regarding ICWA rules and forms.

Deadline to Submit Comments: Monday, June 10 at 5:00 p.m.

Importance of the comment process

We encourage you to review the proposals carefully. The comment process is vitally important to the work of the Judicial Council. Proposals are frequently revised because of the comments received. Your comments will make a valuable contribution to the council’s decision-making process.

Please submit comments electronically on the California Courts website, at: http://www.courts.ca.gov/policyadmin-invitationstocomment.htm or by e-mail to:  invitations@jud.ca.gov. The deadline for comment is 5:00 p.m., Monday, June 10, 2019.

 

 

 



The Board of State and Community Corrections (BSCC) and the State Advisory Committee on Juvenile Justice and Delinquency Prevention (SACJJDP) are announcing the release of the Title II Grant Program and Title II Tribal Youth Grant program Request for Proposals (RFP).  Applicants for Title II Grant Program awards must be *** local government agencies***, or Federally recognized Indian Tribes with law enforcement functions, which includes enforcing the law and preventing, detecting, and investigating criminal activities.  Government agencies include individual agencies or departments within a City and County or a School District. 

 

The target population for the Title II Grant Program are juveniles that are under the age of 26.  The Title II Grant program will fund programs that address Aftercare/Reentry, Alternatives to Detention, Community-Based Programs and Services, Diversion, Mental Health Services, and/or Mentoring, Counseling, and Training Programs.  There is an additional opportunity specifically for Federally recognized Indian Tribes with law enforcement functions.  The target population for the Title II Tribal Youth Grant Program are Native American juveniles that are under the age of 26.

 

Proposals must be received by the BSCC by 5:00 p.m. on June 7, 2019.  A copy of the RFP is available on the BSCC website at http://www.bscc.ca.gov/s_titleiigrant
