Editorial

It was almost two years ago that research for the PROMISE project (Preserving Online Multiple Information: towards a Belgian StratEgy) funded by Belspo under the BRAIN program begun… and it already comes to an end.
The main objective of PROMISE is to develop a federal strategy for web archiving in Belgium. Indeed, the lifespan of the majority of websites and web pages is limited. At this time, web preservation is thus a cultural and historical necessity for both researchers and the general public. In that respect, the Royal Library and the State Archives wish to jointly preserve the “Belgian web” in order to safeguard this significant digital heritage. In order to do so, these two preservation institutions work with two universities and one high school: UGent for operational and technical aspects, the Haute-École Bruxelles-Brabant for technical aspects and UNamur/CRIDS for all the legal aspects of web archiving.
As part of the PROMISE project, CRIDS has therefore worked on all the legal issues raised by web archiving, whether in the selection, collection and harvesting of websites; in their archiving and preservation; or in matters of access to archived web contents for researchers and society at large. Indeed, even if Article 10 of the ECHR protects web archives because web archiving activities help to guarantee the “right to information” by facilitating research and access to information, they raise many legal issues. These issues notably include:
  • The respective missions and responsibilities of national cultural heritage institutions in charge of web archiving (Royal Library and State Archives).
  • The delimitation of the national scope of jurisdiction for web archiving activities by defining the « Belgian web » (at what point should a website be considered as part of the Belgian web?).
  • Copyright rules and sui generis right on databases.
  • Privacy and data protection law (in particular, the specific regime foreseen by the GDPR for archiving purposes in the public interest).
  • The probative value of web archives.
  • The status of illegal contents, especially those that may be of interest for researchers.
