Know Your Rights:
What Contract Expiration Means

When a union contract expires, it’s important that you know your rights under California labor law. Our contract with the City of Oakland expired on June 30, 2019. By law, generally, when a contract expires, the City is required to maintain the same wages, hours, and terms and essential conditions of employment until an agreement is reached. This means that you maintain almost all your rights and protections under our union contract. 
 
A few benefits, such as baby bonding, have a set end date for the benefit in our contract. We have strongly advocated to continue this benefit and asked the City to support our union parents and families. 

As a result, the City has agreed to continue the Baby Bonding benefit. 
Mediation with The City Begins on July 23
On July 23, we will meet with City Management and a neutral, outside mediator who has been agreed upon by both parties to begin pre-impasse mediation. Our intent is to use mediation to reach a resolution on all remaining issues. We will continue to strongly advocate that Management agree to improve our wages, benefits, and working conditions so we can recruit and retain staff and deliver better services to Oakland residents. 
 
We have four days of mediation scheduled: July 23, July 29, August 22, and August 23. 

It's more important than ever that we are collectively engaged in actions to build power for our fight. 
 
As you may recall, City Management declared impasse on June 12. Impasse is when bargaining parties have exhausted their ability to make movement and still cannot come to an agreement. We believe that the City’s declaration of impasse was premature and unlawful. We have filed unfair labor practice charges that will continue while we participate in pre-impasse mediation.
