An update on property plans in the neighborhood


Dear Neighbors:
 
Recently we’ve had several questions about activity and plans for the property at 901 40 Ave. N. (For neighborhood newcomers: In the past, this property was sometimes referred to as The Mills Estate).
 
To better understand what’s happening, we reached out to city zoning and planning officials. Here’s what we understanding at this point:
  • According to the current plat, there are eight 60 foot lots on the property, four facing Martin Luther King Dr., two facing 40th Ave, and two facing 41st Ave. (see map below) 
  • Lots 12 and 13, at the corner of 41st Ave and MLK, are for sale. These lots were establish by the previous owner as a separate tax parcel, and can be sold as such. Only one home can be built there.
  • However, there is another property offering running concurrently. The eastern most parcel of land [116 feet] encompasses the four 60-foot lots facing MLK (Lots 12, 13, 14 & 15) is being advertised for sale as a package of  two 85 foot lots, one 75-foot lot and an alley connecting 40th and 41st Avenues. A re-plat and a subdivision application would require City Council approval for this option. There has been no such application at this point.
  • Because lots 12 and 13 are part of both sale options, only one of these sales could be closed.

At one point, there were discussions between the city and the current owner about a plan to demolish the residence and re-plat the entire site into a new seven-lot subdivision. However, as far as we know, there has been no recent activity for this option.
 
New subdivision applications and re-plat applications go to the city’s Development Review Commission, and if approved, to City Council for final approval. The neighborhood would be notified if and when an application was scheduled for DRC action, and we would have the opportunity to voice our positions at that time.
 
This information [again, based on conversations with city officials] is what we know as of this date and is subject to change. We’ll keep you posted via this newsletter and through other communications on this and any other major neighborhood property plans, if and when, they develop.
