In this September e-bulletin, I have included a compilation of key resources to understand the implications of the recent changes in the Aged Care legislation. We will dive into these changes in the next few months through our series of roundtable discussions to support CEOs, managers and care co-ordinators. Keep an eye out for registration in the coming week. As usual, other Sector news and events have also been included.

The Aged Care legislation is changing
The Aged Care and Other Legislation Amendment (Royal Commission Response) Bill 2022 received royal assent on the 5th of August 2022. It amends the law relating to aged care and health and aged care pricing and implements 9 measures in response to 17 Royal Commission recommendations. Changes directly affecting in-home care include:
  • Code of Conduct and Banning Orders - from 1 December 2022. 
  • Serious Incident Response Scheme extended to in-home providers - from 1 December 2022. 
  • Strengthened Governance of Approved Providers - from 1 December 2022. 
  • Information Sharing across Aged Care, Veterans' and Disability sectors - now in place.
  • Independent Health and Aged Care Pricing Authority - now in place.
This Explanatory Memorandum to the Act provides a summary of these new requirements for approved providers.

Other legislative changes
A second piece of legislation Aged Care Amendment (Implementing Care Reform) Bill 2022 is currently being debated in Parliament. It contains measures to amend the Aged Care Act 1997 requiring approved providers of residential care and certain kinds of flexible care to ensure a registered nurse is onsite and on duty at all times, enables the capping of prices of approved providers of home care and removes the home care providers' ability to charge an exit amount. Aged Care Learning Information System (Alis): Free trial

Alis is the Aged Care Quality and Safety Commission’s online learning system for aged care sector workers. It contains more than 25 modules covering topics including the Quality Standards, the Serious Incident Response Scheme and outbreak management. More modules will be added throughout the year.
The Commission is trialling free access to Alis for all workers of CHSP providers. More information and registration here.

There are many opportunities to contribute to discussions about the Aged Care reforms via the Ageing and Aged Care Engagement Hub here. These include surveys about the new approach to regulating Aged Care and Aged Care pricing changes.

Organised by the Aged Care Quality & Safety Commission, the objective of the webinar is to provide an overview of the new Aged Care and Other Legislation Amendment (Royal Commission Response) Act, with a particular focus on the 4 measures that are directly relevant to the regulation of aged care, and which will apply from 1 December 2022. The Aged Care Workforce Industry Council (ACWIC) has developed a series of fact sheets to better understand the Australian aged care sector. These include insights on the current workforce, the future of the workforce, managing an aging population and how employees feel about the Sector here. Additionally, the 2020 Aged Care Workforce Census Report provides interesting insights about the Sector (here).
