As we near the end of the 2022 NH Legislative Session, next week is a big week, as many priority bills will be on the floor to be voted on by the full NH House of Representatives and Senate. There is still time to contact your health center's representatives before the floor votes next week. Here is a summary of committee recommendations that happened this week: 
  • HB 1022 permitting pharmacists to dispense the drug ivermectin by means of a standing order: Under this bill, pharmacists would be able to dispense ivermectin under a “standing order,” without needing a prescription from someone’s physician. Two amendments, both from Sen. Bradley, were considered: #1633s and #1826s. #1633s sets up a commission to review standing orders for ivermection and evaluate making the provision permanent. Sens. Sherman and Whitley supported amendment #1633s and opposed #1826s. Sen. Bradley listed the history of standing orders in NH for other drugs like Narcan, but Sens. Sherman and Whitley said this is different: Ivermectin is not FDA approved, and two studies have shown it does not cure COVID. Senate HHS voted to approve HB 1022 with amendments by a vote of 3 to 2
  • HB 1080 relative to the rights of conscience for medical professionals: This bill provides that health care providers have a right to conscientiously object to participating in providing abortion, sterilization, or artificial contraception services. The bill requires health care institutions to prominently post a notice to this effect and establishes civil remedies, including fines, for its violation. Sen. Avard supported ought to pass. Senate HHS voted to refer HB 1080 to interim study by a vote of 4 to 1
  • HB 1131 prohibiting mask mandates in schools: This bill would remove a school board's ability to implement a mask mandate in the event of a medical emergency, like the Covid-19 pandemic. Senate HHS voted HB 1131 ought to pass with amendment by a vote of 3 to 2.
  • HB 1210 relative to exemptions from vaccine mandates: This bill would add a new undefined “conscience” objection to exemptions from workplace vaccine mandates. Sens. Whitley and Bradley cited the testimony of employment lawyer Andrea Chatfield as most compelling. Passage of HB 1210 would put ~$2.3 billion in federal Medicaid and Medicare funding at risk annually because the federal government does not recognize a conscience objection for vaccines. Sen. Bradley said the financial risk was too great to support the bill. Sen. Avard's motion of ought to pass failed. Sens. Gray and Bradley said they could not support ought to pass. Senate HHS voted to refer HB 1210 to interim study, by a vote of 4 to 1.
  • HB 1455 relative to state enforcement of federal vaccination mandates: Sen. Bradley proposed amendment #1449s, which exempts any entity that is subject to CMS and said this is a good compromise. The amendment passed 5 to 0, but Sens. Whitley and Sherman opposed the bill. Senate HHS voted HB 1455 ought to pass with amendment by a vote of 3 to 2. 
  • HB 1526 relative to income eligibility for in and out medical assistance: This bill would increase access to health care by expanding the income limits for participation in NH’s “In & Out” Medical Assistance Program. Senate Finance voted HB 1526 ought to pass with amendment by a vote of 5 to 0. 
  • HB 1606 making the vaccine registry opt-in: This bill would weaken NH's vaccine registry by forcing individuals to opt-in participate rather than allowing them to opt out, as is the case under current law. Senate HHS voted HB 1606 ought to pass with amendment by a vote of 4 to 1. 
  • HB 1609 relative to certain provisions of the fetal life protection act requiring an ultrasound examination: This bill adds a critical exception for fatal fetal diagnoses to NH's current 24-week abortion ban and removes the requirement that all people seeking abortion care first undergo an ultrasound, at every stage of pregnancy, regardless of whether it is medically necessary.   • SB 422 establishing an adult dental benefit under the state Medicaid program and HB 103 establishing a dental benefit under the state Medicaid program: Both bills would extend the state’s Medicaid program to cover dental services for individuals in need. Senate Finance voted HB 103 ought to pass by a vote of 6 to 0. 

Other updates: 

  • The NH Senate voted down two bills to legalize cannabis: HB 629 relative to the home cultivation of cannabis plants and the possession of certain cannabis-infused products and HB 1598 legalizing the possession and use of cannabis. Read NH Bulletin article.

New Hampshire Updates
NH CEO Call (5/3, 9:00 am)
We look forward to seeing you this Tuesday at our May NH CEO Call, with special guest Mary Dowes from BerryDunn, who will present an annual review of aggregated financials from 9:00-10:00 am. We will also have a brief chat on Community Health Workers to get a better idea of the number of CHWs in our state for our Equity Grant work with the State of NH. NH Medicaid Continues COVID-19 Funding
While the HSRA program for free COVID-19 vaccines and testing ended this month, the NH Medicaid COVID-19 Group is still available at nheasy.nh.gov so that providers can assist vaccine recipients to enroll. It fully covers the cost of COVID-19 vaccination, testing, and treatment for any person who otherwise does not have insurance coverage.
Endowment for Health's Workforce 2022 Full Report
This strategic plan, published in March 2022 and intended for implementation within two years, includes 107 strategies to build and retain NH's health care workforce in four areas.
COVID-19 Developments
Hold on Over the Counter Test Kits from NH DHHS
NH DHHS had to put a pause on the OTC Test Kits for FQHCs. They anticipate being able to release test kits on or after 5/23. Facilities can continue to order test kits, and the orders will be held until 5/23. Once everything is cleared up, DHHS will message facilities that your test kits will be available for pick-up. If urgent needs arise for additional testing beyond what is being provided with the Binax distribution, please reach out to Craig Beaulac at dhhs.eprr@dhhs.nh.gov, and DHHS may be able to provide some alternatives in the meantime.

Virtual Film Screening of Someone You Love: The HPV Epidemic (5/11 or 5/26)
Join us for a free virtual film screening of Someone You Love: The HPV Epidemic followed by discussions with experts in the fields of pediatrics and public health. Choose one of the two breakout session options: 5/11, 7:30-9:30 am or 5/26, 2:00-4:00 pm. Registration if required, and space is limited! We welcome clinicians, health center staff, school nurses, and anyone else interested in attending. NACHC's Monthly Telehealth Office Hours (5/12, 2:00 pm)
Register here for NACHC’s Best Practices for Building Operating, and Sustaining a Telebehavioral Health Practice, where Clinical Psychologist Dr. Jonathan Neufeld will review the best practices for building, operating, and sustaining a telebehavioral health practice in an FQHC setting. He will cover strategies for improving etiquette, assessing and mitigating patient risk, and updates on telehealth billing and policies related to the COVID-19 pandemic and public health emergency. View NACHC’s collected telehealth resources for health centers, including recordings from previous Telehealth Office Hours. New sessions convene the 2nd Thursday of each month.

All Hazards Emergency Preparedness & Response Learning Collaborative (Beginning 5/17)
In this four-part learning collaborative, participants will discuss lessons learned from the COVID-19 pandemic to inform future emergency preparedness efforts. Speakers will highlight the efficacy of an all-hazards, multidisciplinary preparedness approach, as well as specific measures health centers should take to comply with the CMS Rule for Emergency Preparedness. Topics will range from planning for and responding to natural disasters, cybersecurity threats, active shooters, and other emergencies. Participants will also review after-action reporting and business continuity. Sessions occur between May and June 2022. Register and learn more.

HRSA Workforce Grand Rounds Webinar Series: Telehealth (5/24, 1:00-2:30 pm)
Join HRSA to discuss telehealth's impact on the health care workforce, its role in bridging primary and behavioral services, potential barriers and challenges with telehealth services, and the future of telehealth in a post-pandemic world. Join the webinar on 5/24.

2022 Telehealth Summit Save the Date (11/15, 8:00 am-1:00 pm)
The NH Telehealth Alliance is hosting the 2022 Annual Summit on November 15th. Mark your calendars for an in-person, half-day event featuring discussions around broadband deployment, emerging technologies, and the advantages of telehealth as a means of health care. 2022 UDS Manual & Upcoming Webinar (5/11, 1:00-2:30 pm)
The 2022 Uniform Data System (UDS) Manual provides health centers with detailed reporting instructions and example data tables that support calendar year 2022 UDS reporting. 2022 UDS reports are due by February 15, 2023.
Changes for 2022 UDS reporting, as outlined in the 2022 UDS Program Assistance Letter (PAL), include:
  • The addition of long COVID as a diagnostic measure on Table 6A.
  • An update in methodology for using patient chart sampling to report clinical quality measures on Tables 6B and 7.
  • Updates to Appendix D: Health Information Technology Capabilities Form, including a new measure that asks health centers to report the total number of patients screened for social risk factors.
Access the manual, PAL, and other materials on the new UDS Training and Technical Assistance microsite, a central, user-friendly hub for health centers to access UDS reporting resources. A ~4-foot California kingsnake made multiple appearances during Kristine's time in Arizona. (Don't worry - it's not poisonous)! They are said to be named "kingsnakes" for their ability to dominate and eat other snakes, even much larger ones.
