Version 4.0 of the Mackay Region Planning Scheme commences


Council at its Ordinary Meeting on Wednesday, April 13, 2022, adopted several amendments to the planning scheme, including major amendment 2, administrative amendment 8, administrative LGIP amendment 2, minor amendment 5 and Planning Scheme Policy (PSP) amendment 4. All adopted amendments, except for PSP amendment 4, are consolidated into a new version 4.0 of the planning scheme. All amendments commenced on Tuesday, April 26, 2022.

Council makes a General exemption certificate for Local heritage places

 
Council has made a General exemption certificate for Local heritage places in accordance with section 75(3) of the Queensland Heritage Act 1992. The purpose of the General exemption certificate – Local heritage places is to support amendments made under Major amendment 2 to make all building work on local heritage places assessable development.
 
The General exemption certificate – Local heritage places exempts certain minor building works such as those that support ongoing maintenance and activities necessary to keep heritage places (identified by the planning scheme) in active use, good repair and optimal operational condition. No assessment against the Planning Scheme’s Heritage and neighbourhood character overlay code is required for this work if carried out in accordance with the conditions of the document. The General Exemption Certificate – Local heritage places does not exempt any other type of development that may be triggered by the Mackay Region Planning Scheme 2017, Planning Regulation 2017 or the Building Act 1975.

Council endorses proposed Major amendment 3 to commence a state interest review

 
Council at its Ordinary Meeting on Wednesday April 27, 2022, endorsed the prepared major amendment 3 to the Mackay Region Planning Scheme 2017 (the proposed amendment) and resolved to give notice to the Minister for State Development, Infrastructure, Local Government and Planning to undertake the state interest review.
 
The proposed amendment focuses on the Pioneer Valley townships of Finch Hatton and Eungella. The current planning landscape of both townships have been analysed through a local area planning project, which recommended opportunities for the facilitation of a range of uses to support the Pioneer Valley mountain bike project and associated opportunities, which forms the basis of the proposed amendment.
 
The purpose and general effect of the proposed amendment to the planning scheme is to:
  • Facilitate commercial and other specific non-residential uses within designated precincts and through appropriate provisions under the Township zone in the Finch Hatton and Eungella townships;
  • Encourage a wider range of uses or adaptive re-use by changing the zone of a small number of lots to Township in the Finch Hatton and Eungella townships; and
  • Reduce the levels of assessment for certain uses to facilitate appropriate development outcomes for the Finch Hatton and Eungella townships in support of the Pioneer Valley mountain bike project.
 
The proposed amendment will now go through a state interest review process. Public consultation will commence after the state interest review is completed.
