As the Chair of the ADR Section of The Florida Bar, last month and this month will continue to be busy as we submit written comments to numerous proposed Rule changes that impact litigation and dispute resolution in Florida.

The Florida Supreme Court has made it clear that it will continue to look at ways to streamline, modernize, and make the legal system more efficient as a means to reduce the burgeoning court dockets.

To learn more, check out the two major policy shifts from the Judicial Management Council Work on Improved Resolution of Civil Cases, and the Committee on Alternative Dispute Resolution Rules and Policy.

 


A Resource
Next month is the Annual Florida Bar Convention. I am proud to announce that the ADR Section in conjunction with the Trial Lawyers Section, is hosting a first-time event, "A Discussion Between Trial Lawyers and Mediators About Improving Mediation Within the Rules of Ethics" as the Presidential Showcase. 

If you ever want to listen to seasoned mediators and litigators discuss how to improve mediation and its effectiveness, this is the event to attend.

 

A Tip
Karma is all about cause and effect. What you do now, will inevitably have an effect in the future. This is undeniable logic.

If you want positive outcomes, you should focus on positive actions. This applies to everything in life, including health, wealth, work, and family. Actions include words. What you say, what you do not say, when you say it, and how you say it, makes all the difference.

For the purposes of having an intent to resolve disputes and have less conflict, what can you say for that outcome? Do some reverse engineering with visualizing an outcome and then figure out the words for how to make that happen. This is the essence of speaking in a mindful and intentional way to resolve conflict.

As I state in all of my mediations, the best space for a resolution is one in which people can make informed decisions. Informed decisions require information and you can only get that by sharing. Sharing requires trust and rapport, and you can only get that by being honest, respectful, and genuinely curious as to the other side and what they have to say.

So I ask you, what will you say in May so there is less conflict and more resolution?
