In February 2020, Abigail* was doing yardwork in her rented home and was struck by a tree limb. Due to her injury, she was unable to work and consequently fell behind on her rent. Abigail called Legal Services of the Hudson Valley for help. Her attorney, Patience Hughes, was able to negotiate a settlement with the landlord. Then the pandemic hit.
Due to the pandemic, Abigail could not find work. She was able to maintain her monthly rent payments but could not pay the negotiated judgment and was served with a 14-Day Eviction Notice. Fortunately for Abigail, evictions were halted during the pandemic. She applied for the Emergency Rental Assistance Program (ERAP). The ERAP application process requires that both the landlord and tenant to apply together. Unfortunately for Abigail, the landlord decided not to apply and proceeded with the eviction for non-payment.
