Environmental, Natural Resources, and Energy Law 2022 Symposium:
The Clean Water Act at 50: Requiem or Resurrection?
Lewis & Clark's annual environmental law symposium focused on the The Clean Water Act at 50: Requiem or Resurrection? The event started with remarks from EPA Region 8 Administrator (and LC alum) Kathleen Becker and Associate Dean Janice Weis. National recognized legal experts such as Rachael Salcido, Cliff Villa, Pat Parenteau, Craig Johnston, Victor Flatt, Allison LaPlante, Jamie Saul, Kevin Cassidy, Nina Bell, and Kevin Minoli (and other practitioners as well) addressed issues regarding Water Quality and TMDLs, Waters of the U.S. and Wetlands, Agriculture and Non Point-source pollution, as well as environmental justice. Lewis & Clark Law has a renowned reputation for its Environmental Law program, but faculty and students alike also gain from experiences outside of the classroom. Professor Lisa Benjamin and 3L student Akriti Bhargava were co-authors of the seminal report on “Climate-Washing Litigation Legal Liability for Misleading Climate Communication.” Read more.

Professors Cited in Ecuador’s Landmark Decision

Ecuador’s Constitutional Court recently issued a landmark decision extending the rights of nature to wild animals. In reaching its decision, the Court cited an opinion piece by Professors Lyman and Fromherz of Lewis & Clark Law School’s Global Law Alliance for Animals and the Environment. Read more.

The decade-long fight for public access to Oswego Lake
Opinion by Professor Michael Blumm

Lewis & Clark Law School and Jeffrey Bain Faculty Scholar Professor Blumm, who lives in Lake Oswego, published an opinion in the Oregonian this May regarding the continued controversy over public access to Oswego Lake.

Professor Blumm has been involved in an important case since 2017 involving the public trust doctrine in Oregon regarding access to the lake (located in the community of Lake Oswego, down the road from the law school). The plaintiffs – assisted by Blumm - challenged a city ordinance that prohibits the public from entering the lake from three adjacent city parks, as well as a city policy limiting use of a city-owned swim park to city residents. Environmental Moot Court Team Triumphant (Again) with National Title


The environmental law moot court team of students Haley Nicholson, Kassie Kometani and Matt Campa, coached by Professor Craig Johnston, were named national champions of the 2022 Jeffrey G. Miller National Environmental Law Moot Court Competition (NELMCC).  “This was our eighth national championship in my 31 years, in a competition that has teams from between 50-75 law schools every year (...)" said Johnston. "Next year, we’ll be going for number 9!” In addition to the national titles, Lewis & Clark Law students have placed 16 times in the finals, 24 times in the semi-finals, and 29 times in the quarterfinals. Haley Nicholson (3L) was honored as the best oralist at the entire competition. STUDENT PERSPECTIVES

 

Franklin Lagat, an attorney in Kenya, recently graduated with a Master of Law (LLM) degree in Environmental Law through the online program offered at Lewis & Clark Law School. Lagat spoke about the degree and how it expanded and broadened his knowledge of environmental issues and wildlife law. Read more.
