Judge Rules - STOP B2H Appeals!

 

Administrative law judge Webster did it again!  She ruled 100% in favor of Idaho Power and the Oregon Department of Energy. While we were not surprised given the kangaroo court of the past 22 months, we were surprised that not one of our issue prevailed in the eyes of this biased judge. It’s puzzling but also ripe for appeal. 

Our awe-inspiring “contested case warriors” not only have survived these legal proceedings but continue to delay and stifle Idaho Power’s profit-seeking and environmentally destructive plans. The opposition thought they could bury us in paper and procedures, and honestly, they came close.  But 14 warriors (aka petitioners) persevered and filed appeals June 30th to Oregon's Energy Facility Siting Council (EFSC).  Thirty issues are being appealed ranging from scenic values, historic preservation, timber values, noise control, fish passage, weed control, soil protection, and much more!.   

We do not know when EFSC will hear our appeals but you know that we will keep you informed.  In the meantime, and continuing by popular demand, here are two more case summaries. (more case summaries, here.)

More Case Summaries!

Back by popular demand, here are two more of the contested "Case Summaries.” These are issues in our case against Idaho Power (IPC) and the Oregon Department of Energy (ODOE). We’ll keep posting as we get them summarized. They are also posted on our Facebook page--check it out--stopb2h.

Michael McAllister (with daughter Hailey Rose, in photo) has been involved in our David & Goliath battle since the beginning.  Michael is a Professional Landscape Ecologist and has been less of a "stop the line" guy and more of a "if they are going to build it, they better do it right!" One could say that he was the designer of the federal (NEPA) preferred route in Union County; however, Idaho Power chose not to apply for that route with the Oregon Department of Energy.  Hence, Michael has joined STOP and became a contested case warrior.  His case focuses on the lack of coordination between the state and federal regulatory processes, and the fact that Idaho Power has not followed state law.  Read more: Link.
Joanne "Jo" Marlette:  Protection of the National Historic Oregon Trail Interpretive Center (NHOTIC). Similar to a few others' issues dealing with the Interpretive Center, Jo's issue deals with visual impacts as it relates to the Historical, Cultural and Archeological standards.  A long-time active community member of Baker City, she has been involved with the Interpretive Center since inception--when it was just an idea. Facing the dire economic situation in Baker County after the timber wars, she was active in creating the tourism destination. Now, she is fighting to protected it and prevent Baker County from another painful economic transition. Read more: Link.

Rulemaking -- again? 

Protect Our Special Places

Time to protect our Scenic, Protected, and Recreation Areas from poor siting of energy development.  We have been reporting in our past newsletters about various rulemaking activities which are intertwined with the B2H, such as wildfire, land condemnation, and this one: Protective, Scenic and Recreation areas. 

Recently, member group, Greater Hells Canyon Council (GHCC) and other conservation organizations, have joined our efforts. We've been dissecting the draft amendments for these new rules to assure strong protections. We will be sending an Action Alert soon, with talking points and links for your comments.  Please keep an eye out for that Ale

Protecting Wild Lands and Habitats From Energy Development

The mountains and canyons of the Greater Hells Canyon region contain some of the best wildlife habitat in Oregon.  Unfortunately, these important wild lands are at risk as potential locations for energy development.

For example, here at GHCC we’re continuing to work with our friends at Stop B2H to prevent the Boardman to Hemingway (B2H) electric transmission line.  This high-voltage powerline would clear cut forests, disrupt critical deer and elk winter range habitat, cut roads through roadless lands, introduce invasive weeds, and increase wildfire risks near communities.  It would create a 300 mile long disruption of habitat connectivity across northeast Oregon.

Looking at the big picture in Oregon, when developers propose an energy project such as B2H, their application must be reviewed by Oregon’s Energy Facility Siting Council (EFSC).  Oregon’s EFSC is required to follow specific rules when reviewing an application for an energy development for a project such as B2H.

Oregon is currently updating these rules for Protected Areas, Scenic Resources, and Recreation Standards.  This is important because these new rules will determine the future levels of protection (or lack of protection) for these important values.

GHCC is engaging with EFSC to advocate for important protections to be included in the new rules.  It’s essential that the new rules protect the integrity of wild and open spaces and connected habitats that are so important for wildlife.  We’re very grateful for the significant efforts of our allies at Friends of the Columbia Gorge, Stop B2H, and numerous other volunteers and organizations all working to protect these values.

EFSC will accept public comments on the rulemaking until July 21.  We plan to send out an action alert in July with updates and specific information about how you can participate in the process.  Right now, we’d just like to let you know about the rulemaking process and the opportunity to weigh in on the process in July.
