"The ability to ask very beautiful questions - often in very un-beautiful moments - is one of the greatest disciplines of a human life. And a beautiful question starts to shape your identity as much by asking it as it does by having it answered."

- David Whyte
Hello Fam,

Do you like larger-than-life art? Take a stroll through the pictures from the Dakar Biennale and enjoy a moment to celebrate (virtually!) that exhibits like these can take place again.

In this week's e:zine, we're taking a look at some news from here, raising our eyebrows at a bizarre story of an aeroplane driving down the streets of Lagos (for real), and listening in to a citizen's tale of playing Zimbabwe's stock market. You can also read more about big wins for accountability elsewhere on the continent, and jam along to an Africa Day mixtape from our friends at New Frame.

As always, we've not forgotten your weekly dose of inspiration and all the jobs & opportunities you love so much... so dive in!

Enjoy the winter sunshine,
The Kubatana Team
After an extended break due to Covid, the Dakar Biennale, one of the largest events in the African modern art world, is back! Under the theme ‘Ndafa’ - which means to forge out of the fire - the displays and installations scattered throughout the city tell stories of triumph and emergence. The sculpture pictured here, by Senagalese artist Diadji Diop, symbolises the emergence from the pandemic and a moment to catch one’s breath. See more here

Mbare eviction order
Once again, Harare City Council is back in the spotlight, for all the wrong reasons. Thousands of families in Mbare’s Joburg lines have reportedly been issued with eviction notices, having accrued significant rental arrears over time. While families admit having failed to pay rent, Council does not appear to be interested in engaging with residents who argue that there are a number of mitigating factors that ought to be considered. Chief among these factors is the point that, in addition to rent, council rates far exceed what most families can afford - and then aren’t even used to maintain basic infrastructure in the community. Some tenants also feel they should have been offered title deeds, having lived in their homes for several decades.

Age of consent
Last week, the ConCourt handed down a ruling that effectively raises the legal age of consent from 16 years old to 18. The ruling follows an application, made by Loveness Mudzuru and Ruvimbo Tsopodzi, to challenge the constitutionality of their customary marriages entered into before the girls were 18. While the legal age for marriage has been 18 years old since 2016, the Marriages Act set the age of consent for sexual relationships at 16 years old. This new ruling seeks to align the Marriages Act with section 78 of the Constitution. While it is hoped that this new ruling will help deter the exploitation of girls by older men, some critics have raised concerns that this ruling may be unrealistically moralistic and difficult to enforce.

Teachers take top spot
It’s a well-deserved pom-pom this week to the Amalgamated Rural Teachers’ Union of Zimbabwe, who were announced the recipient of this year’s FrontLine Defenders Award for Africa. The award was given in recognition of ARTUZ’s tireless efforts over the past 14 years in “working to improve the working conditions of teachers, and to defend and ensure equal access to education.” While highlighting the perpetual obstacles facing ARTUZ’s quest for better teaching and learning conditions in Zimbabwe, the award citation also highlights the Union’s campaign for the adoption of the Education Equalization Fund; the development of their Remote Teaching Toolkit, which trained 1800 teachers on remote teaching techniques during the pandemic; and the Safe Schools campaign. Listen to ARTUZ President Obert Masaraure speaking on the award and the state of education in Zimbabwe here

Journalism is not a crime
On Friday last week, police visited the home of ZimLive editor Mduduzi Mathuthu and reportedly ordered that Mathuthu, who was not at home when the police officers arrived, should present himself at the police station. Mathuthu tweeted that according to people present at the time, five men arrived at his home driving a car with no number plates. The Media Institute for Southern Africa (MISA) deployed lawyer Nqobile Sithole who attended the police station on Mathuthu’s behalf, but was not informed of any charges pending against his client. Police previously raided Mathuthu’s home in July 2020, claiming that he had information linked to the July 31 protests. Shortly afterwards, Mathuthu’s nephew was abducted and tortured.

Stranger than fiction

What could be stranger than a plane (yes, aeroplane) being towed (forget flying) on a busy expressway on a Tuesday evening? Last week the Nigerian commuting public was left wondering whether their eyes were betraying them when a plane was spotted in the busy Lagos traffic.

The incident sparked a lot of interest on Twitter. Here are some of the musings that gave us a chuckle:

“What is a plane doing inside traffic in ikeja? which kind country be this” asked @Naomi_Swizz_

“It's a newly invented motor by a smart Nigerian as molue is not enough to convey people that are living towards yanipaja axis so don't be afraid just enter call your bustop they will drop you” chipped in @gwf19892010

“Na Kasali, the mechanic, dey test run the brake weda it dey catch or not” reasoned @Olawale55773901

The Nigerian authorities set the record straight, stating that the plane was being delivered to its new owner via the busy road. You can check out the clip of the plane and the rest of Twitter reflections here

 Accountability watch . . .

Accounting for atrocities
The Gambian government says it will prosecute former President Yahya Jammeh for alleged atrocities, including murder, rape and torture, during his rule of over 20 years. Jammeh, whose tenure was widely viewed as tyrannical, is currently in exile in Equatorial Guinea. The decision to hold Jammeh accountable has been welcomed by ordinary Gambians who “never thought they would one day see him tried in a courtroom” and being made answerable for his misdeeds. A museum has been established outside the capital Banjul, to educate citizens on abuses committed by the exiled former leader. Named Memory House, the museum is dedicated to victims of Jammeh’s despotic rule, and exhibits items which range from photographs of victims, their written testimony and art. According to Sirra Ndow, Gambia country representative for the African Network Against Extrajudicial Killings and Enforced Disappearances (ANEKED), which runs Memory House, “just people knowing what happened is an act of accountability. People forgetting leaves [behind] impunity. . . For most people, they just hear the stories, and they don’t get to feel it. Memory House brings that element of feeling it.”

Patience pays off
Nigerian environmental lawyer, Chima Williams, has been awarded the prestigious Goldman Environmental Prize for his work in holding multinational oil company, Shell, accountable for environmental damage during their operations. In a court battle spanning 13 years, Williams, who is the executive director of the Environmental Rights Action / Friends of the Earth Nigeria, successfully convinced the Court of Appeal in the Hague that the oil giant was responsible for the activities of its Nigerian subsidiary whose oil spills have ravaged local farmlands. The ruling is made more significant by the fact that this is the first time a Dutch transnational corporation has been held accountable for the violations of its subsidiary in another country, “opening Shell to legal action from communities across Nigeria devastated by the company’s disregard for environmental safety.” Shell has since agreed to a settlement with the farmers, represented by Williams, stating that it's "working amiably on the actualization of the judgment." The company is the largest oil operator in the Niger Delta, Africa's largest oil-producing region. While the Delta is rich in so-called liquid gold, the region’s residents face high poverty rates and a largely degraded environment, owing to hundreds of oil spills every year.

Remembering promises
At least 113 people have been injured in Sudan during recent clashes between security forces and anti-military coup protesters. To crush unrest, which has continued six months after a coup that brought a military regime to power, security forces have mounted a fierce crackdown on protesters, targeting resistance committees - a network of informal associations that have organised most of the protests. According to pro-democracy activist Yousef Abdallah Adam, “in the last few days, they have increased the arrests. Two from our [resistance] committee were taken at the weekend. There have been lots of other people taken. We are keeping a low profile these days.” Legal representatives have claimed that at least 80 protesters have been detained in less than two weeks, with many having been sent to prisons far from their homes. While this fresh wave of arrests will likely slow protests’ momentum, “the resistance committees will continue to exercise their right to peacefully protest despite the pressure on them, … until they achieve a civilian government,” said Osman Basri, of the Emergency Lawyers’ Association in Khartoum. Sudan’s state of emergency, which it has been under since the October 2021 coup, has just been lifted to "to prepare the atmosphere for a fruitful and meaningful dialogue that achieves stability for the transitional period."

Discarded hotel guest soap is finding its way out of landfill and into the hands of people who need it thanks to Shawn Seipler, founder of Clean the World. The nonprofit, headquartered in Orlando, Florida, was set up to clear the environment of the hotel bar soaps thrown away daily. Seipler recycles bar soap from over 8,000 hospitality partners, including Marriott International. His organisation collects, melts, reforms and packages partially used soap left behind by hotel guests, and to date has distributed nearly 70 million bars of soap in more than 120 countries. Clean the World has seven warehouses worldwide and hotels can register to receive collection boxes online. "If you’re staying at a hotel that does not use our program, take the soap home with you, keep it out of a landfill, use it in your homes," Seipler recommends.

The freedom in music
Music has changed the lives of prisoners in New Bell prison in Douala, the largest city in Cameroon. Jail Time Records, a non-profit record label, has given prisoners a chance to make something of their lives by providing a recording opportunity in the city. “We have people who have really changed because they have the opportunity to record for free,” says Steve Happi, who founded the label in 2019 with Italian artist and director, Dione Roach. The studio was set up after Happi realised the talent housed by the prisoners. “It gives them hope that, one day, they can be one of those artists with a lot of success. It’s like a new page in their life,” adds Happi. Anti-Do-To, an activist streetwear brand from Italy, producing a clothing line featuring artwork by prisoners in New Bell, has funded a new studio to allow prisoners who have left incarceration to continue to find purpose outside of crime and improve their lives. “I miss my mum and my sisters and brothers, but I’m good because music is holding me up. If I didn’t have this, I would have gone crazy,” shared Jennifer, a 19-year-old from Nigeria who is currently in prison. Jail Time Records’ first double album, Jail Time Records Vol 1, will be released this summer.

Playing the market in Zimbabwe. A citizen’s tale

At 9 am every weekday, Albert Nangara, a chemical engineering student at Midlands State University, Zimbabwe, starts juggling his attention between studies and “the board”. 9 am is when the Zimbabwe Stock Exchange opens and Nangara needs to keep at least half an eye on prices. Nangara is one of a growing cohort of young Zimbabweans who have plunged into the stock market, buying and selling shares using social media platforms. But trading like this requires attention.

“Money never sleeps. I constantly have to monitor my social media feeds for any news that might impact my investment portfolio. So by the time the market opens, I have read and caught up with the news of the day,” Nangara says.

The ZSE, established in 1894, is one of the continent’s oldest bourses, only a little younger than the oldest – the Egyptian Exchange (EGX), founded in 1883 – and the Johannesburg Stock Exchange, established in 1887. For nearly a century it was an enabler of white capital. After independence, it became the domain of key Zimbabwean companies but the wider population was largely excluded from stock ownership. That all changed in 2015, when the exchange migrated to an online trading platform. It soon caught the eye of young digitally savvy would-be investors, like Nangara.

The 25-year-old started his trading journey in 2020, at the height of the Covid-19 outbreak. He has since reaped dividends from trading stocks which he has used to pay his college tuition and meet other expenses. He said that he now has a “decent stream of revenue.”

Without any formal training in investment or finance, Nangara credits the film Pursuit of Happyness, starring Will Smith, with the inspiration behind his foray into stock trading. The 2006 blockbuster follows the story of Chris Gardner, a single parent down on his luck who learns the ins and outs of the stock exchange to change his fortunes.

Before its digitisation, trading on the stock exchange was primarily an exclusive activity reserved for investment professionals. The exchange itself operated manually, with traders on the floor shouting over each other. Since digitisation, it has also featured heavily on social media, where Nangara and others pick up prices and tips.

“Social media gives us access to endless streams of information. It also connects us to like-minded peers who help us make meaning of the day’s news,” says Nangara, who has amassed a considerable following on Twitter, with his tips.

“The only way you can be on top of your game is by researching the company you are considering investing in. Make sure to read the news and look at the company’s financial reports and recent business developments. If everything looks solid, then you can invest,” he adds.

Shares are partitions of a company’s capital, offered for sale at the stock exchange. With as little as one Zimbabwean dollar, one can buy a share that can later sell at a higher or lower price.

The value of the shares – or what traders refer to as the share price (the price of a single share of a number of saleable equity) is a result of market forces; it can go up or down, depending on micro and macroeconomic developments.

“From the rising oil prices on the international markets, to local policy pronouncements, it is all connected,” Nangara says.

The extent to which the Zimbabwean public has been buying into shares became evident when, on May 7, Zimbabwe’s President Emmerson Mnangagwa announced measures to limit trading activity on the Zimbabwe Stock Exchange (ZSE).

The exchange’s Zimbabwe Industrial Index had climbed from 25,513 on August 31 2021 to 97,112 on April 29, 2022.

The announcement sparked an unpreceded furore on Twitter, with many of the new entrants dominating ZSE-related sites on the platform.

The directive seemed to generate more heat than light. To some, it was an indirect way of restricting new entrants into the stock exchange, to retain the status quo.

New measures included the imposition of higher Capital Gains Tax – a levy on the profits of the sale of property or investment such as shares– of 4 percent, up from the previous 2 percent on the disposal of shares held for less than 270 days.

According to the government, this would help contain the overpricing of stocks which it said was “fuelling inflation and weakening the exchange rate.”

One consequence was instant: when the ZSE resumed business under the new capital gains tax regime, there was an immediate hesitation from investors, who were still trying to make sense of the new rules to take up stocks. A decline which had begun at the beginning of may saw the Industrial Index decline to below 68,000 by May 20.

Michael Nyabande, a 26-year-old “techie” who dabbles in capital market investments, sent out a tweet to his nearly 1,500 followers.

“Morning, fellow ZSE Investors. Are we still buying the dip [when share prices go down], after Saturday’s pronouncements, or is now a good time to hit pause and explore alternative investment?”

“Guys, relax” Godwin Mungwadzi, who describes himself as an entrepreneur, tweeted in response to the mayhem that gripped the youthful community of investors.

While the new measures were clearly unsettling on the investor community, one thing was clearly evident: the growing community of largely young Zimbabweans that are showing interest in the stock exchange. The activity brings to mind the keen public interest shown in Kenya’s stock market in 2008 when communications company Safaricom listed in that country and queues of people wanting to buy shares stretched along several city blocks.

Penkline Tugineamatsiko, Stock Dealer at UAP Old Mutual Financial Services Ltd, in Uganda, explained that while some African bourses have made it easy for citizens to get involved in trading, others have not. Also, over-regulation of markets can directly affect their performance, leading to limited liquidity, which makes it difficult for would-be traders to make trades.

“In the East African region, we realize that Nairobi Securities Exchange has several listed companies, of which 70% of the companies listed are liquid. However, in Uganda, we have about 19 listed companies, but about four or five are liquid. So, there is not much for investors to deal with.”

Key to the level of individual interest in trading on the ZSE is the buzz on social media. Investors and investor groups post updates from the exchange, share stock picks, brag about their growing portfolio, and cry about them, too, when the market does not perform as well as expected.

For Nyabande, social media is a huge part of his investment strategy. It has not only opened up what was previously a highly elitist and exclusive environment but also paved the way for a younger and tech-savvy generation that is now mining the empowering potential of the exchange.

Nyabande is part of several groups and communities on WhatsApp, Twitter, and Telegram, which discuss stocks. It helps him keep his ears to the ground.

He is not a fan of technical analysis, but rather, “monitoring sentiments amongst other investors and learning from experts gives me unique insights into the market,” he says.

These online communities and the launch of applications such as “C-trade” and the ZSE’s own “Direct” have made capital markets much more accessible.

“One can trade from the comfort of their home so long they have a mobile phone or a laptop,” Nyabande explains.

Tugineamatsiko agrees. According to her, e-trading has opened the markets to far more investors in Africa, especially young people.

“More and more people are using their mobile phones to pay bills and carry out other transactions. The same can be done with the capital markets industry to increase participation,” she says.

A recent study on why the local bourse had not attracted many locals noted that the best shares are often held by local pension funds, banks, and insurance firms that do not want to sell because they have few alternative assets to buy with the sale proceeds.

But other than this, barriers to entry have mostly been more perceived than real. And these perceptions have been carried on for generations up until now. Tugineamatsiko asserts that a major challenge is that most people lack basic knowledge about capital markets; what is involved, how to participate, and whom to approach.

“There is need for financial literacy for the public for them to appreciate the role of the capital markets industry, and what it does. If you compare it with the banking industry; if you go to the deepest village, one will know what a bank is and what it is does. But if you were to ask someone in the city center about the capital markets, they don’t know,” Tugineamatsiko explains.

“So, there is a need for the capital markets industry to go deeper, do public sensitization so that information can be broken down to the people in a language they understand,” she adds.

Research conducted by the ZSE in 2020 indicated that participation by individual Zimbabweans in the local capital market was marginal. Some of the barriers cited include a lack of appreciation of the investment process and the perception that it is the domain and preservation of the sophisticated in society.

This survey prompted the bourse to launch ZSE Direct, a product that would make access to the market straightforward even for first-time investors.

“ZSE Direct came in to complement the platforms already in the market to provide more choice for investors and increase retail participation as we drive financial inclusion. An investor can register, fund their wallet, buy and sell securities and monitor market performance remotely through the web portal or mobile application,” says Justin Bgoni, the ZSE chief executive.

Another electronic platform, C-trade, allows users to buy and sell financial instruments such as stocks and bonds using mobile phones or laptops and gives brokers access to significant online investment traffic.

According to the Securities and exchange commission of zimbabwe (Seczim), which regulates the capital markets, retail investors trading on the ZSE through C-trade now account for more than half of the trades happening on the local bourse.

Before the launch of C-trade, it was estimated that only around 7 000 individuals were active on the local stock markets, with institutional investors dominating trades on the bourse.

All this contributed to Seczim exceeding its targets for 2021, with daily stock market turnover 98 per cent above the initial target.

“In the ensuing year, we expect more activity in the market, mainly coming from retail investors, due to availability and accessibility of trading platforms and new listings,” said EFE Securities, a local stock brokerage firm.

Given the country’s high mobile penetration rate of 90 per cent, the ecosystem is likely to see more online trading activity, opening up capital markets even further to the (previously) financially excluded.

Desk Study on the State of Financing of Zimbabwe's Higher and Tertiary Education Sector vis-à-vis College Fees Regulation: Education Coalition of Zimbabwe (ECOZI)
Deadline: 8 June 2022 (12noon)

Background and context
The efficacy of higher and tertiary education as it relates to economic efficiency and social justice is unparalleled. There has been global emphasis on higher and tertiary education in most recent decades with a confirmation that access to higher and tertiary institutions increased worldwide and gross enrolment rate doubling between 2000 and 2018 (UNESCO, 2020). Even with the phenomenal growth rate in higher and tertiary education enrolment, inequalities to access have persisted premised on high tuition fees among a plethora of inhibiting variables. The increase of university/college fees is continuously becoming a recurrent issue characterized by a large outcry by students and parents for institutions of higher and tertiary education to reduce their fees. The lack of a framework which regulates how fees are charged by such institutions has led to the petitioning of the Parliament Portfolio Committee on Higher and Tertiary Education Innovation Science and Technology Development (PPC on HTEISTD) by student bodies like the Zimbabwe National Students Union (ZINASU).

It is against this background that ECOZI would like to conduct a desk study to assess the state of financing of Zimbabwe’s higher and tertiary education sector vis-à-vis college fees regulation.

The specific objectives of the study are: To understand the impact of fees, increase on student enrolment and program completion; To understand the impact of the increase of fees on the welfare of students; To explore how Zimbabwe’s higher and tertiary education sector is being financed and establish sustainable higher and tertiary education financing model(s).

Reporting and payment plan
The consultant shall be expected to produce the following: A full report on the state of financing of Zimbabwe’s higher and tertiary education sector vis-à-vis college fees regulation; To make a presentation of the report during a dialogue with college students and college representatives.

A final report is expected to be submitted in 5 working days after signing of contract.

Researcher(s) specification
ECOZI invites applications from consultant(s)/ agency, able to demonstrate the following skills, knowledge and experience: The consultant should have an advanced degree (Masters) in Public Administration, Social Sciences or a related discipline with provable experience working on Higher and Tertiary Education Policy and Public Policy issues. The researcher (s) should demonstrate ability to use participatory research techniques and understanding of quantitative and qualitative methods. Excellent interpersonal and verbal communication skills. Well versed with policy making discourse (preferably influencing public consultations).

Due to the nature of the assignment, the researcher will need to be based in Zimbabwe during the duration of the assignment.

To apply
Interested and qualified consultant should submit the following documents: Curriculum Vitae, Expression of Interest and financial proposal to info@ecozi.co.zw
