 UNREGISTERED PRODUCTS –

Trainers are again alerted to the following Rules.

HR 194.  A person who:
(a)  Procures or attempts to procure;
(b)  Has in his possession or on his premises or under his control;
(c)  Administers or attempts to administer;
any substance or preparation that has not been registered, labelled, prescribed or obtained in compliance with relevant State and Commonwealth legislation is guilty of an offence.

HR 194A.  A person who:
(a)  Sells or attempts to sell;
(b)  Supplies or attempts to supply;
(c)  Distributes or attempts to distribute;
any substance or preparation that has not been registered, labelled, prescribed or obtained in compliance with relevant State and Commonwealth legislation is guilty of an offence.

From time to time Stewards note “unregistered products” when visiting stables.  These substances have been confiscated and, in some instances, have been sent to Racing Analytical Services to be analysed.  None of the substances analysed to date have contained any of the alleged “performance enhancing” ingredients, or substances prohibited by the Rules?

Trainers should understand that unless substances have been appropriately prescribed by a registered Veterinary Surgeon or purchased from a legitimate retailer, it is not possible to ensure the integrity of a product or its providence.  Products purchased through homeopathic sources, compounding chemists, through the internet or from “rogue suppliers” will likely not be registered for use by the Australian Pesticides and Veterinary Medicines Authority (AVPMA) and therefore will likely offend the Rules.   In the event that warnings have previously been issued to a Trainer, penalties may result where unregistered products are discovered in stables.

VETERINARY SURGEONS -

When Trainers seek professional advice they should understand that there is a State Government requirement for a person to be registered in the State in which he/she is practising.

Trainers are alerted that HRSA suspects a Veterinary Surgeon “operating” in the horse racing codes in South Australia may not presently hold registration as prescribed by Legislation.  Trainers are advised to make their own inquiries in this regard.

RESTRAINING DEVICE –

Recently, a Trainer professed ignorance regarding the meaning of a “restraining device” as prescibed by the following Rule.  NOTE – Neither the current wording or the previous wording which specified ONLY “a rearing bit” was considered to include a head stall or halter as a restraining device.

HR 220.  A person shall not lead a horse at a racecourse other than by way of a lead rope attached to a properly fitted restraining device.

For, clarity Trainers are notified in South Australia (and Victoria) the Rule is interpreted that the words “restraining device” shall only mean one of the following, fitted properly and attached to a lead rope; a rearing bit, a bridle (to which a lead is attached to the bit) or a stallion chain fitted either over the nose or through the mouth.

Participants are reminded that failure to comply with this requirement may result in a penalty being imposed by Stewards.

ADHERENCE TO STARTERS CALLS –

Drivers, and Trainers are advised that going forward they will be required to respond to the Starter’s Calls to attend the Parade Ring pre-race.

Presently, there is a lack of compliance to this requirement which requires attention from Trainers/Drivers.

If a particular horse is deemed “unsafe” in the Parade prior application may be made to the Stewards which will treated strictly on-merit.   Any application for exemption must be made immediately on arrival on course.

Note – Presently only one horse holds such exemption.
