The US Supreme Court’s June 30th, West Virginia v. EPA decision restricted some of the authority of the EPA to compel a reduction in Greenhouse Gas (GHG) pollution from power plants. The Court thus appears to have narrowed the quantum of discretion it traditionally accords federal agencies when they interpret laws that Congress directed them to implement.

CPR Initiative's June 16, 2022 filing kicked off a 90-day statutory deadline for EPA to grant or deny our Petition. Accordingly, just 73 69 days from now (and counting) EPA must determine whether or not GHG pollution "presents an unreasonable risk of injury to health or the environment" — and, if so, to kick-off a rulemaking proceeding to limit that risk.

If not, we will need to see the Agency in court.

Getting this done right will not be easy, but it is possible, if we do it together.
