Individuals & Small Biz ➡ Paid Family And Medical Leave Insurance Program (FAMLI)

Back in Nov 2020, Colorado voters approved Proposition 118, and this paved the way for a state-run Paid Family and Medical Leave Insurance (FAMLI) program.

Fast forward to today, when we finally know when individuals and small businesses alike will start to see this proposition's impact.

Here's everything you need to know (for now) about FAMLI. ⬇️

Overview

What is FAMLI?

The FAMLI program ensures all Colorado workers have access to paid leave so they can care for themselves or their family when life takes them away from their jobs.


How much paid leave is provided?

Eligible employees will receive up to 12 weeks of leave. Those who experience pregnancy or childbirth complications will receive an additional four weeks.


What circumstances qualify under FAMLI?

  • expanding your family
  • taking care of a sick loved one
  • experiencing an accident or serious illness
  • being called up for military deployment
  • + more

When does everything start?

Both employers and employees will contribute premiums for the program.
  • Employees may start to see a premium contribution from their employers on their pay stubs beginning Jan 1, 2023.
     
  • FAMLI will start providing benefits to employees beginning Jan 1, 2024. 

How much will it cost?

The premiums are set to 0.9% of the employee’s wage:
  • .45% paid by the employer
  • .45% paid by the employee

More Info For ...

Individuals

  • Most Coloradoans will be eligible after they've earned at least $2,500 in Colorado income within the last four quarters.
     
  • Employee contributions will vary depending on how much you earn.
     
  • You can calculate your estimated contribution using the FAMLI Premiums and Benefits Calculator.

Small Businesses

  • Business with fewer than 10 employees will not be required to contribute anything, but they do need to remit their employees' share each quarter.
     
  • Those who offer a privately funded paid family leave program may opt out of FAMLI as long as they offer the same or better benefits.
     
  • Employers may also opt to cover their employees' FAMLI contributions as an added benefit.

✭ Important Dates 

INDIVIDUALS
Sep 15 - Q3 2022 estimated tax payments are due
Extension filers have until Oct 18 to file their Form 1040.
SMALL BUSINESSES
Jul 31 - Q2 2022 payroll tax forms due
Extension filers have until Sep 15 to file their Forms 1120S & 1065.
