"Cincinnati’s pay-to-stay ordinance has yet to be enforced, but an upcoming court ruling could change that.
Cincinnati Council passed pay-to-stay last year. It’s supposed to force a landlord to stop a nonpayment eviction if the tenant can pay all past due rent and fees. Hamilton County magistrates announced their decision not to enforce it on the day it went into effect in December, saying they think the local ordinance conflicts with state law.
It was an unusual move, considering there was no legal challenge to the law; nor is there one now.
Legal Aid is challenging that decision in one particular eviction case, where the tenant has a voucher from the Community Action Agency for rent assistance from federal stimulus funds.
At a hearing on Friday, Municipal Court Judge Dwane Mallory said he can’t find any conflict in state law.
“Only the executive branch, that I'm aware of, has discretion to enforce a law or not. The judicial branch does not do that,” Mallory said. “Also, there's been no declaration that this ordinance was unconstitutional … There's no law on the books that conflicts with this one. And if there is, please let me know. I've looked."
That seems to agree with what Legal Aid attorney Zach Frye has been arguing in court..."

One affirmation said, “I’ve made so many friends I will never forget at camp.” Ms. Miller was especially thrilled to find this beautiful affirmation in the box this morning: “Ms. Miller is so nice and the best teacher I have ever had. I love her, thank you Ms. Miller.” We’re not crying, you’re crying.

The purpose of Tender Mercies is to provide housing and supportive services for adults with histories of severe mental illness and homelessness. Our permanent supportive housing model addresses the root causes of homelessness, thereby preventing a return to the streets for our region's most vulnerable persons.

Congratulations to Matt Fitzsimmons on his promotion to Senior Attorney at the Legal Aid Society of Greater Cincinnati!
Matt joined Legal Aid in 2018 after five years in private practice. As a member of Legal Aid’s Housing and Consumer Practice Group, he represents people in eviction defense cases to keep tenants housed and ensure their rights are enforced. He also works on foreclosure prevention and consumer protection cases, including representing consumers sued for old car-debt. Additionally, Matt is the Ombudsman for the Southern District’s Sewer Back Up claims process, providing homeowners and the public with guidance on navigating back-ups claims reviews.
Matt received his B.A. from the University of Dayton; his M.P.A., from The John Glenn School of Public Affairs at The Ohio State University; and his J.D. from the University of Cincinnati College of Law.

After celebrating Juneteenth for the second time as a federal holiday, there are issues #BeyondJuneteenth that urgently deserve to be addressed. Juneteenth may be a holiday, but freedom for all has yet to occur when we are still fighting against systemic racism.
Voting rights are still a prominent issue happening today, but with many other injustices rising around us, it has unfortunately been moved to the backburner.
As we approach midterm elections, we cannot risk the repercussions of not continuing to address this issue head-on. Let’s look at some facts!

Death Penalty Information Center released a new data report that identifies and documents every death sentence imposed in the United States since the United States Supreme Court decided Furman v. Georgia in 1972. It highlights what many of us know, the death penalty is arbitrarily applied and rooted in racism. Fewer than 1.1 percent of counties in the country are responsible for all of the death sentences. Check out their report below to explore more of the census sentencing data.
