As first reported by WTOP, the Loudoun County School Board has appealed to the Virginia Supreme Court, asking it to overturn the Loudoun County Circuit Court's decision to allow the special grand jury to proceed. The notice of appeal was filed under seal by the school board, despite its previous argument that the circuit court hearing should be conducted in public.
Per WTOP, the Office of the Attorney General filed a motion opposing the request to file under seal:
"On Wednesday, attorneys representing Miyares’ office filed a motion opposing the board’s request to file the appeal under seal.
'The School Board’s counsel argued vigorously against sealing the courtroom and transcripts at the July 11 hearing,' according to the attorney general’s filing. At the time, Plowman agreed with the School Board, and the hearing was open to the public and media.
Solicitor General Andrew Ferguson said in the filing that the School Board “seeks to seal materials that are already publicly available.”
Following the report, Fight for Schools Executive Director Ian Prior issued the following statement:
"The Loudoun County School Board and Superintendent Scott Ziegler are terrified of what might result from this special grand jury investigation. They continue to make the hail mary argument that the Loudoun County School Board is above the law and cannot be held accountable for any wrongdoing. This continued waste of taxpayer dollars is yet another embarrassing example of a school system that is far more concerned with its political agenda than it is truth, accountability, and student safety."
