American University Provost Division employees who are represented by SEIU Local 500 have a legal right to strike.
It is illegal for the American University administration or management personnel to threaten workers with termination, discipline or a loss of pay or benefits if they strike.
The American University strike is also an unfair labor practice strike. This means it is caused, in part, by AU’s unlawful conduct and bad faith bargaining. An unfair labor practice strike gives workers added job protection when the strike is over.
We want every represented AU employee to strike every day of the strike. Individual workers may have crossed the picket line, went to work and then changed their mind to come out and join the strike. This is legal, protected activity.
The AU administration has circulated misleading documents that mischaracterize the federal labor law in how they define intermittent strikes. An intermittent strike occurs when the Union as a whole organizes a series of short strikes every few weeks to disrupt the operations of the Employer. We are not engaging in intermittent strikes and if an employee works and then comes out on strike – it is their legal right and it is protected by federal labor law.
