What you’ll do:

  • You will respond to clients’ requirements and deliver results, whilst maintaining and supporting the maintenance of a proper work/life balance;

  • Support and work alongside the partners and your colleagues in the team and across all departments in the firm;

Who we are looking for?

Candidates must have 10 years’ experience in a similar role, be currently working in private practice and have confidence in:

  • Residential Conveyancing acting in sales and purchases
  • Acting in mortgaging and refinancing of client properties
  • Be up to dates with all provisions relating to new properties & apartment purchases
  • Be proficient in case management systems, MS word, outlook and online searches and registries.

The position is suitable for a qualified solicitor with 10 years post qualification experience and good academic background and training.

A proven track record in fee earning ability is a requirement for this role.

The individual will be a good communicator with excellent attention to detail.

Secretarial and typing support will be available but IT and MS Word drafting proficiency will be important.

Hours

This role is 20-30 hours per week and will can be a combination of working remotely along with office attendance. We can be flexible on the final arrangements for the right candidate.

We also welcome applications from remote workers and workers located in regional locations.

Salary

The salary will be set at a market level pro rata basis depending on experience, capacity and agreed number of hours. Regard will be had to standard fee earning multiples.

Head of Legal – Office of the Ombudsman

The Office comprises the Office of the Ombudsman; the Standards in Public Office Commission (SIPOC); the Office of the Information Commissioner (OIC); the Office of the Commissioner for Environmental Information (OCEI); the Commission for Public Service Appointments (CPSA); and the Referendum Commission, when established. The six offices carry out separate and distinct statutory functions.

The Office of the Ombudsman examines complaints from people who feel they have been unfairly treated by certain public bodies, for example, government departments, local authorities, the HSE and publicly funded third level education bodies. It receives a large volume of complaints from individuals unhappy with the administration of healthcare in public hospitals and other public healthcare settings, as well as social work services.

The successful candidate will:

  • Have experience as a practicing solicitor or barrister of no less than five years or, having qualified as solicitor, experience working in a similar legal advisory role, in a comparable organisation, of no less than five years;
  • Hold a practicing solicitor certificate;
  • Hold a practicing barrister certificate;
  • Have considerable experience in the area of public and administrative law;
  • Have experience in litigation;
  • Have an ability to quickly develop competence in the diverse range of areas for which the Office has responsibility;
  • Have excellent oral and written communication skills.

As the Equal Status Acts enter their third decade in effect in Ireland, FLAC is delighted to invite you to an online Seminar Series, in which academics, practitioners, policy-makers and activists will reflect on the experience, impact and limitations of this legislation to date, and explore its future role in Ireland’s equality framework.

The Equal Status Acts prohibit discrimination, harassment and victimisation in the provision of goods, services, education and accommodation. They cover the nine grounds of gender, marital status, family status, age disability, sexual orientation, race, religion, and membership of the Traveller community. The enactment of this legislation represented the fulfilment of a commitment contained in the Good Friday Agreement and placed Ireland at the forefront of Europe in terms of anti-discrimination legislation.

However, in recent years, the number of complaints made under the Equal Status Acts has begun to decline. Questions continue to be raised about the legislation’s compatibility with Ireland’s obligations under international and regional human rights instruments.

The recent commitments by Government - to examine the introduction of a “disadvantaged socio-economic status” ground and to review Ireland’s equality legislation generally - afford another opportunity for Ireland to act as European leaders in promoting equality and combatting discrimination.

The seminar series will examine these issues and seek to contribute to the debate about the future of Ireland’s equality law. Roderic O’Gorman TD, Minister for Children, Equality, Disability, Integration and Youth will deliver the series’ Closing Address on Tuesday, 22nd June 2021.

NI: Solicitor Trevor Ringland appointed special envoy to US on Northern Ireland

Belfast solicitor Trevor Ringland MBE has been appointed by the UK government as the first special envoy to the United States on Northern Ireland.

Mr Ringland, a partner at Macaulay & Ritchie Solicitors, will be responsible for promoting Northern Ireland interests across the US, including in the administration, Congress and within the Irish-American community.

He will also tasked to work with US firms and investors with an interest in Northern Ireland to build on established links and support Northern Ireland's long-term economic development.

Mr Ringland, also a former rugby union player who made 31 competitive appearances for Ireland, will report to the Secretary of State for Northern Ireland and the Prime Minister.

Northern Ireland Secretary Brandon Lewis said: "I am delighted that Trevor has accepted my invitation to take up this position to represent the UK Government in Northern Ireland, working to support its best interests in the United States.

"This is an exciting new appointment and recognises Northern Ireland’s unique relationship with the United States and its people. I look forward to working with Trevor to harness all the opportunities that lie ahead."

Mr Ringland added: "I am honoured to take up this role on behalf of the UK government.

"I very much look forward to supporting the Secretary of State for Northern Ireland in ensuring the UK government’s policies on Northern Ireland are well represented to US audiences and playing my part in forging deeper political, social and economic ties between our two countries."

NI: Professor Grainne McKeever to chair review of discretionary support scheme

Professor Grainne McKeever, professor of law and social justice at the University of Ulster, has been appointed to chair an independent review of the discretionary support scheme.

Professor McKeever will be joined on the panel by Dr Ciara Fitzpatrick, also of University of Ulster; Gerry McConville of the Falls Community Council; Jonny Currie of the Trussell Trust; Ursula O’Hare of Law Centre NI; and Kevin Higgins of Advice NI.

Discretionary support was introduced to replace Social Fund community care grants and crisis loans following their abolition as part of Westminster welfare reforms in 2016.

Communities Minister Deirdre Hargey said: "Discretionary support was designed to ensure that immediate assistance could be given to individuals who found themselves facing extreme circumstances.

"The obvious need for such a programme was called into sharp focus last year with the onset of the Covid-19 pandemic.

"However, it was clear enhancements to the scheme were needed to support people on low incomes who were worst affected by the pandemic – so we made sure these enhancements were made.

"I want to do more so I have appointed an expert panel to review the Discretionary Support scheme.

"This review gives the panel scope to look at all aspects of the current programme and to provide any recommendations needed to make it better."

She added: "I would like to thank the panel chair, Professor Grainne McKeever and the other panel members, for taking forward this review, which I have asked to be completed within a short three to four month timeframe.

"I look forward to receiving the panel’s recommendations and to supporting people who find themselves in extreme situations."

Arthur Cox named top Irish law firm at Benchmark 2021 awards

Arthur Cox has been named Ireland's top law firm at the Benchmark Litigation Europe Awards 2021.

The firm claimed the Ireland Firm of the Year award, while Eve Mulconry, partner and head of the litigation, dispute resolution and investigations group, was named Ireland Litigator of the Year.

Ms Mulconry has over 24 years’ experience practising litigation in Arthur Cox, specialising in large-scale commercial litigation across a range of areas including banking, financial services, property and shareholder disputes.

The firm also received two Impact Case Awards for “Irish Bank Resolution Corporation (In Special Liquidation) v Thomas Browne” and “Private Hospitals Association”.

Call for statutory gender quotas on Irish corporate boards

Statutory gender quotas on corporate boards are effective and should be introduced in Ireland, the National Women's Council of Ireland (NWCI) has said.

The national women's membership organisation will launch a report later this month titled Increasing Gender Balance on Boards: The case for legislative gender quotas in Ireland.

The launch event on Thursday 24 June will hear from NWCI director Orla O'Connor; Dr Pauline Cullen; Anne O'Leary, CEO of Vodafone Ireland; Frances Fitzgerald MEP; Senator Fiona O'Loughlin, chairperson of the women's parliamentary caucus; and Mark Fenton, CEO and founder of MASF Consulting.

Over 600 victims of Hillsborough disaster to receive pay-out from police forces

Over 600 people will receive damages from South Yorkshire Police and West Midlands Police as part of a settlement over the cover-up following the 1989 Hillsborough disaster, in which 96 football fans were unlawfully killed.

The settlement, bringing to a close large-scale group litigation which began in 2015, was reached at the end of April but could not be made public until the end of the criminal trial of a former police solicitor and two former police officers.

The criminal trial collapsed last month because the charge of "perverting the course of justice" could not apply to evidence given to the 1989 Taylor Inquiry because it was not a statutory public inquiry.

The 601 people who will receive damages include survivors of the disaster and family members of those who were killed. The total sum to be paid has not yet been agreed.

In a statement, Saunders Law, which represented 219 of the individual claimants, said: "We trust that this settlement will put an end to any fresh attempts to rewrite the record and wrongly claim that there was no cover-up.

"In so commenting, we contrast the dignity of the bereaved families and the supporters, with the conduct of those who still seek to peddle the discredited lies of the past."

Slovenia approves new definition of rape as sex without consent

Slovenia has become the 13th country in Europe to pass legislation defining rape as sex without consent.

The new amendment to the Slovenian criminal code, debated for nearly three years, removes the requirement for evidence of use of force or the threat of use of force and violence to classify an act as a rape.

The country joins Belgium, Croatia, Cyprus, Denmark, Germany, Greece, Iceland, Ireland, Luxembourg, Malta, Sweden and the UK in having consent-based legal definitions of rape.

The governments of Spain and the Netherlands are currently holding consultations on similar changes to their respective laws.

Nils Muižnieks, Europe director at Amnesty International, said: "This is a historic victory for women in Slovenia and an important step along the road to changing culture, attitudes and behaviour. It is also a testament to years of campaigning by survivors who have helped to ensure that other women do not have to go through what they endured.

"Shockingly, Slovenia is only the 13th country in Europe to recognise the simple fact that sex without consent is rape, although more countries are changing their legal definitions of rape.

"There is still a great deal of work to be done to challenge the deep-seated attitudes to rape and harmful gender stereotypes, but today we take a moment to celebrate."

UK: Lady Hale calls for use of caravan courts

Lady Hale has advocated the use of caravan courts to restore local justice and spare participants long journeys.

The former Supreme Court justice suggested mobile courts could compensate for the hundreds of court buildings closed by the UK government.

She told the National Pro Bono Centre conference on access to justice that the closures had made it less likely that court users would attend hearings.

She said: “I come from North Yorkshire. If somebody gets burgled in my town — magistrates’ court-type offences — they have to go a very long way to get to court to give their evidence.”

She said that remote hearings would not help people who lacked the appropriate technology.

“What we need to replace what we have sadly lost is mobile courts,” she said.

“We need a caravan court which consists of a judge and magistrates and an official [that] tours round the various towns and villages [and] enables real local justice to take place.”

She added: “It’s the little things that go by the way unless you’ve got real local justice available. We need to get back to that situation and there are good, cheap ways of doing it.”

The sale of 61 courts is thought to have raised about £122 million for HM Treasury. Some believe, however, that the total figure could reach £250m.

UK: Kingsley Napley to offer paid leave for loss of pregnancy

A law firm is to become the first to offer paid leave to staff who have been affected by the loss of a pregnancy.

Kingsley Napley employees will be allowed 10 days' paid leave in the event of miscarriage, abortion, stillbirth or neonatal loss.

Managing partner Linda Woolley said the new entitlement would “validate the experiences” of staff.

“We recognise that not only the person physically experiencing the loss, but also their partner, will be experiencing pain,” she said.

As the law stands, employers are not obligated to offer parents paid leave if they lose a pregnancy before 24 weeks. Losses that occur thereafter are deemed a stillbirth, with employees entitled to parental leave.

Pregnancy loss leave is already in use at Channel 4 and the digital bank Monzo.

About 250,000 pregnancies a year end in miscarriage according to the Miscarriage Association.

England: Adultery gives way to 'bad behaviour' in divorce inquiries during Covid

Divorce lawyers have reported a sharp fall in inquiries mentioning adultery during the Covid-19 pandemic, alongside a sharp rise in inquiries mentioning "bad behaviour".

London firm Vardags said inquiries mentioning adultery declined by 63 per cent during England's latest lockdown, but those citing "bad behaviour", including domestic abusive and coercive control, rose by 78 per cent.

Divorce lawyer Ayesha Vardag, who acted for the successful party in Radmacher v Granatino, which reshaped the law on pre-nups in England and Wales, told The Sunday Times that she thought "people would be a lot less upset about adultery if they didn’t have everyone else telling them that they ought to be upset about it".

Sam Longworth, family law partner at Stewarts, said demand for divorce advice had risen by 122 per cent in July-October 2020 in comparison to the same period in 2019.

He added: "The pandemic really has put a mirror up, shone a light, on lots of relationships. Some of these relationships might otherwise have lasted for ages."

And finally... schlock and awe

A judge has blasted the last two Star Wars films as "mediocre and schlocky" in an otherwise dry judgment on the labelling of cooking oil.

Judge Kenneth K. Lee, sitting in the US Court of Appeals for the Ninth Circuit, summed up the case as "How to Lose a Class Action Settlement in 10 Ways".

The judge pointed out that ConAgra Foods, the subject of the lawsuit, could not make a commitment to stop advertising its product as "100% Natural" because it had sold that part of the business to another company.

"That is like George Lucas promising no more mediocre and schlocky Star Wars sequels shortly after selling the franchise to Disney," he said. "Such a promise would be illusory."

In a footnote, he added: "As evident by Disney’s production of The Last Jedi and The Rise of Skywalker."
