Hello CCCSBA Representatives,
CSBA’s Legislative Committee is scheduled to consider three bills pending in the California State legislature this Friday, June 18, and determine CSBA’s position on each of the bills. 

CSBA’s Government Affairs staff recommends that the association OPPOSE all three bills.

Information on Three Bills to be Considered

SB 237 Portantino Special education: dyslexia testing

Summary: Would require, on or before June 30, 2022, the State Board of Education to establish an approved list of culturally, linguistically, and developmentally appropriate screening instruments to be used by a local educational agency, as defined, to screen pupils for risk of dyslexia, as provided. The bill would require, beginning in the 2022–23 school year, and annually thereafter, a local educational agency serving pupils in any of the grades kindergarten to grade 2, inclusive, to screen each pupil in those grades for risk of dyslexia by using the screening instrument or instruments identified above, as provided. The bill would also require, during the 2022–23 school year, a local educational agency serving pupils in grade 3 to screen each pupil. The bill would require results from the screening, among other things, to be made available to a pupil’s parent or guardian in a timely manner, but no more than 45 calendar days from administering the screening. The bill would require a local educational agency to provide a pupil identified as being at risk for dyslexia with appropriate instruction, progress monitoring, and early intervention in the regular general education program.

 
SB 335 Cortese Workers’ Compensation: Liability

Summary: This measure would significantly reduce existing Workers’ Compensation timelines by: 1) Lowering the period an employer may reject liability for an injury from 90 days to 45 days, 2) providing that a presumptive injury is considered compensable if the claim is not rejected within 30 days, and 3) lowering the time period that if a claim of COVID-19 is not rejected, then the claim is presumed compensable, from 90 to 30 days. It would also increase the amount of medical treatment an employer must immediately authorize for an alleged injury from $10,000 to $17,000. Lastly, it requires that if payment of compensation has been unreasonably delayed or refused for a presumptive injury, then the payment due will be increased by 10 percent.

SB 593 (Glazer) School accountability: independent study, educational enrichment activities, oversight, and audit requirements.

Summary: Current law requires the Controller, in consultation with the Department of Finance and the State Department of Education, to develop a plan to review and report on financial and compliance audits, and, with representatives of other entities, to recommend the statements and other information to be included in the audit reports filed with the state by local educational agencies, and to propose the content of an audit guide. This bill would require the Controller to also consult with the California Charter Schools Association and the Charter Schools Development Center to recommend the statements and other information to be included in the audit reports filed with the state by local educational agencies, and to propose the content of an audit guide.
