The NCAA Board of Governors will meet in November in a special constitutional convention to launch dramatic reform that would be enacted at the NCAA Convention in January. President Emmert: “This is not about tweaking the model we have now. This is about wholesale transformation so we can set a sustainable course for college sports for decades to come. We need to stay focused on the thing that matters most — helping students be as successful as they can be as both students and athletes." Independent Board member and former U.S. Secretary of Defense/Texas A&M President Gates: "Under the current structure, expectations for the Association vastly exceed its capabilities. The NCAA has significant responsibility but little authority to fulfill those responsibilities. The broader Association cannot move quickly. Power is diffuse. Until we can better align the mission of the Association with its authority, the NCAA will not be able to play the role it should play in governing college sports. We cannot go on as we are." The Constitution Review Committee will consist of 22 presidents, commissioners, ADs and student-athletes from all three divisions and be tasked with “identifying the core principles that define college sports and proposing a new governance model that allows for quicker change without sacrificing broader values [...] The committee will also propose a new system of governance and rules enforcement that further contemplates the role of national oversight and places appropriate responsibility at the school and conference levels.” Nominations for the committee are due August 6, with 20 individuals being selected and the committee will meet virtually no later than November 15. Yahoo’s Thamel reports Big 12 ADs held a call this morning and are “not panicking and sticking together. There’s a desire to not react emotionally and give Big 12 leaders the space to evaluate options moving forward.” (link)
Like SEC Commissioner Sankey (one of the members of the College Football Playoff subcommittee who recommended expansion) previously noted, ESPN’s Adelson rattles off points from administrators on why expansion will not slow the move to a 12-team CFP. 1. Revenue Distribution: “The SEC averages 5 teams in the Top 12, including Oklahoma. If every conference gets 1 revenue share for each team that makes the CFP, the SEC stands to benefit even more: The rich getting even richer.” For that reason, there could be added debate on the revenue distribution formula, because nobody outside the SEC wants to see the financial gap the league already has on them grow even further. 2. Zzzzz factor: “If the push for expansion is because people are sick and tired of seeing the same 4 teams play for the national championship, will the same apathy build if/when the CFP continually features 4-5 SEC teams …” 3. What's the rush to make a decision in September? One administrator noting: “Why not let the current contract play out + see where it goes?” Conclusion: “Given all those factors, will there be a pause? Nobody knows. Greg Sankey might be confident everyone can sing kumbaya together, but there is a lot of anger at him and his conference right now. Slowing down the move to 12 might be one way for the other conferences to push back.” (link)
Sportico’s McCann writes on the potential for a lawsuit between the Big 12 and ESPN. If the duo end up in court, McCann finds it “extremely difficult” the league could convince a judge to issue an injunction citing the need for actual proof of the claims in Commissioner Bowlsby’s letter and meet the high legal standard. Further: “The Big 12 would also need to convince a judge it would suffer irreparable injury in the absence of an injunction. A court will usually find there is no risk of irreparable injury if monetary damages could later ‘cure’ the harm. [...] Further, the Big 12 would need to persuade the judge that an injunction would not be adverse to public interest. ESPN could counter that an injunction would interfere with its news reporting, as secured by the First Amendment and Supreme Court precedent, and its ability to report on information that is in the public interest.[...] Even if the Big 12 could persuade a judge to force ESPN to cease and desist, what has the conference, and its member schools, gained versus what has been lost?” (link)
Athlon Sports’ Fischer on the lesser discussed media implications of realignment: “Oklahoma’s FoxSports/BallySports deal should expire after next year. Does ESPN pick up third tier rights if OU is still in Big 12 as way of helping finance an early exit a la LHN/Texas? Something to consider. [...] Larger component to CFB realignment/media deals/CFP expansion: M&A discussions in Hollywood are a hot topic right now. Could NBC get spun off? Will ViacomCBS get bought? What does Fox do? Amazon not done? All will need content and Disney showing how to build using sports.” (link, link)

Out of Bounds purveyor Wittry examines what the last month has been like for compliance officers based on email correspondences at Minnesota, Florida and Boise State. Thus far in the NIL era, compliance officials are the ones tasked with monitoring student-athlete social media for any NIL activity, troubleshooting issues with reporting and educational software and advising on the permissibility of deals-- a task, however, that represents a tricky gray area, with UConn Assist. AD for Compliance Schneider cautioning a student: “You’re more than welcome to speak with one of us prior to the 12th, however the only thing we are permitted to provide you is education on the ncaa legislation, state bill policies, and institutional policies… but if it’s anything about a contract, signing, taxes, etc., then you would have to consult with an outside individual about that.” Among other challenges include international students and how accepting NIL money impacts their visa status, as Bowling Green Director of Federal Relations Snitch points out: “Universities must be EXTREMELY CAREFUL with international student athletes and NIL. The Department of Homeland Security has this on their radar and is said to be preparing guidance. Issue - IF an international student accepts funds for NIL, they may put their student VISA in jeopardy.” Licensed merchandise, trading cards and use of institutional marks represent still more hurdles for compliance offices, as does the Barstool Athlete program. Boise State Assoc. AD for Compliance Brewer, in an email to a student: “I understand Barstool signed up several athletes this weekend without getting permission from the schools. They were aggressive with how they approached [student-athletes], so we will use this as more of an education moment, so make sure to disclose the opportunity and we will get them vetted. State laws prohibit working with gambling companies. Our policy also states that. Now we need to determine if Penn Gaming and Barstool are the same for the purposes of the state laws." Lots more. Please read the contract AND understand it. New data from the CDC says the Delta variant is more likely to break through vaccine protections and is more contagious. From the New York Times: “Dr. Rochelle P. Walensky, the director of the agency, acknowledged on Tuesday that vaccinated people with so-called breakthrough infections of the Delta variant carry just as much virus in the nose and throat as unvaccinated people, and may spread it just as readily, if less often. [...] Dr. Walensky has called transmission by vaccinated people a rare event, but other scientists have suggested it may be more common than once thought.” More. (link)
