NMHCA/NMCAL developed the attached poster to assist facilities in communicating the differences in guidance and direction for assisted living and nursing facilities from the general public. We invite you to print as many copies as you'd like and post them around the areas or send them to families, so they have a clear understanding of the guidance you are required to follow.
Annual Membership Meeting
The NMHCA/NMCAL Board of Directors has called for a meeting of the membership on Thursday, August 19, 2021, beginning at 7:30 am at the Embassy Suites - Albuquerque located at 1000 Woodward NE. The primary purpose of this meeting is to elect the 21-22 Board of Directors. All member facilities may have 1 representative attend at no cost, but please RSVP so we can have accurate counts for space and breakfast. Download the RSVP form here.

Liability Study: Your Information IS Important
Marsh's National Senior Care Practice and Oliver Wyman's Actuarial Practice are conducting a 2021 update to their Professional and General Liability Benchmark Report for Long Term Care Providers. This analysis is sponsored by AHCA/NCAL is open to all New Mexico Health Care Association/New Mexico Center for Assisted Living (NMHCA/NMCAL) members. There is no cost to participate, and all participants will receive a copy of the report and an invitation to the presentation of the results.
The information presented in this study is a critical component in various insurance industry initiatives and supports multiple state tort reform efforts. Especially relevant for 2021 will be the effect that the pandemic has had on losses. This benchmark study is also an important resource relied upon by insurance carriers, actuaries, and of course, long-term care and senior living providers.
The information Marsh and Oliver Wyman are collecting includes:
- Individual claim listing (excluding Protected Health Information) in Excel-readable format valued as of 12/31/2020.
- Occupied bed equivalent exposure information for the past 10 calendar years, if available.
In order to enhance the quality of this initiative, we are asking providers to please participate in this benchmark study by adding your information to the collection data form and submit it to LTCBenchmark@oliverwyman.com by July 31, 2021.
Upon data submission we will provide diagnostic information about your own data including various metrics, e.g., frequency and severity claim statistics; closing year, report year, and accident year statistics; open and closed claim statistics; and an exposure analysis. We will review the data diagnostics and contact you to discuss any potential anomalies.
Unfortunately, ONLY a limited number of New Mexico’s Long Term Care Providers have historically participated in this analysis. As result, there has not been enough data and to credibly develop New Mexico specific findings. Last year the absence of New Mexico specific findings resulted in NMHCA/NMCAL having to expend a significant amount of membership funds in order to develop a New Mexico benchmark analysis. As stated above this information is utilized by NMHCA/NMCAL in its legislative lobbying efforts related to tort reform efforts.

OSHA ETS Comments Wanted - Deadline Extended
As you may be aware, effective June 21 the Occupational Safety and Health Administration (OSHA) released Emergency Temporary Standards (ETS) to address exposure to COVID-19 to workers in healthcare settings. This healthcare ETS applies to skilled nursing facilities, assisted living communities, and Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICFs/IID). Compliance is required within 14 days (July 6) for most items and 30 days (July 21) for a few requirements. Please visit the AHCA/NCAL website for a link to the webinar for further details along with links to OSHA resources.
AHCA/NCAL is asking members to submit comments before the August 20 deadline. Comments may be submitted online here. Attached please find a PDF of the PowerPoint presentation with details about the ETS. Priority areas outlined in the PowerPoint to include in comments are:

- Reporting to Other Employers
- Consistent Guidance
- Supports through Consultation
