We have been in touch with all clients via emails who have been affected by this change. But we wanted to share this more widely that with pleasure we can now announce that the EU has officially deemed the UK ‘adequate’ for transfers of data from the EEA. This means personal data can be sent from the EEA to the UK without any additional safeguards (such as the model clauses) being in place, meaning no additional steps are required for data to be legally transferred from the EEA to the UK.
For transfers from the UK, the UK Government recognises EU Commission adequacy decisions made before the end of the Brexit transition period. This allows restricted transfers to continue to be made from the UK to most organisations, countries, territories or sectors covered by an EU adequacy decision. The UK has already recognised all EU and EEA Member States as ‘adequate’ for transfers from the UK.
