Status of Marvin Heritage District:
Frequently Asked Questions

Earlier this summer, the Village Council scheduled a public hearing to consider adoption of the proposed Marvin Heritage District (MHD), which had been vetted through the Marvin Planning Board and the MHD Strategic Plan Committee (comprised of local residents) and guided by a lengthy public involvement process.

At Council’s review, there were a few minor amendments needed to be in compliance with state-wide legislative changes (commonly referred to as NCGS 160D) made concurrent to the formation of this plan. In addition, Council wanted to ensure there were mechanisms in place to have general oversight of residential aesthetics for uniformity within the district.
 
Below is a list of FAQs to recap a few MHD highlights and next steps:

Q: What is the location of the MHD? Has there been any officially approved zoning maps on the proposed district?
A: The Marvin Heritage District is proposed to be located along New Town Road between Marvin Road and Marvin School Road. The official zoning map of the proposed district has not yet been approved. Expected district creation and zoning map is anticipated in Fall/Winter of 2021.
Q: There were recently rezoning signs across this corridor, did the Marvin Heritage District rezoning get approved then?  
A: No, the application was temporarily withdrawn until the district is officially created and adopted. Procedurally, the district has to be in place before the rezoning can be approved. Among the changes being made to the proposed zoning district include: Minor amendments such as 160D compliance (as required by North Carolina General Statute); a greater residential aesthetic review process; and clarifying additional duties and processes for administration (such as MHD board rules/procedures, etc.).

Few steps remain, but this is an important next step for the Village of Marvin, so we want to assure its well written and understood from the start; we don’t want to rush this everlasting district that will be Marvin’s main corridor.


Q: What steps remain to the official establishment of the district?
A: A “small area plan” for the district is being proposed which will be adopted as an amendment to the Village of Marvin 2020 Land Use Plan. This is anticipated to be adopted by the Village Council this Fall. This will assure the MHD Board, Planning Board, and the Village Council all have the greatest level of overall consideration when reviewing developments that may be proposed within the district; in short, the small area plan creates a solid mechanism to enable and encourage  these boards to assure what is proposed in the area is uniform and what residents want to see in their community. We don’t want to look like Main Street USA, we’re Marvin, NC; and we want to preserve our quaint rural atmosphere for years to come!

The proposed district which will be a zoning text amendment to the Marvin Ordinance Code will enable property owners to apply for rezoning within the corridor. These documents will go through the MHD Strategic Planning Committee, the Planning Board, and the Village Council. Meeting dates and documents will be posted on our website when the documents are completed and meetings are scheduled.
Q: Will there be opportunities for more public input?
A: Yes, at the MHD Strategic Planning Committee, Planning Board, and the Village Council meetings when those are scheduled. There will also be Public Hearings for the consideration of adoption of the Small Area Plan for the Marvin Heritage District (as an amendment to the Village of Marvin Land Use Plan 2020) and for the consideration for adoption of Zoning Text Amendment to the Village of Marvin Zoning Ordinance to establish the Marvin Heritage District as a Zoning District. Keep a check on our website and the emails you get from the Village; all of these will be emailed for public notice.

Q: Is the Marvin Heritage District supported by Marvin residents? How have you assured public input to make sure the district is exactly what residents envision?
A: Yes, in a community-wide survey conducted in 2019, 54% of households supported the Heritage District while 35% opposed and 11% responded undecided. The membership composition of the appointed Marvin Heritage District Strategic Plan Committee, along with following citizen survey results have assured the details of the Marvin Heritage District were based on public input.

Q: What allowable non-residential uses will be permitted along this corridor?
A: The vision currently includes only small stores and light commercial uses such as: restaurants (but not drive-thrus), cafes, small specialty shops, and offices (e.g. real estate, insurance).
