Questions I WISH My Clients Would Ask

Last month, I answered three questions I am frequently asked by clients. That got me thinking about what I wish my clients would ask me — questions that could head off potential legal problems and, just as importantly, unexpected expenses.

If you’re involved in a family law dispute (or, frankly, any legal dispute), you may find these useful:

Q1: Is it important to wait to file a case involving children until I can pass a drug test or alcohol abuse test?

Yes! If the Court has any reason to believe that either side has been using illegal drugs, the Court can order a drug test immediately upon leaving the courthouse, whether either party asked for it or not. In some cases, the other party brings to the courthouse a drug laboratory technician who takes the sample of whatever is ordered at the courthouse. If abuse of alcohol is claimed by the other side, the Court can order alcohol testing on an ongoing basis. One is a #Soberlink device and the other is a blood test that measures the liver enzymes indicating excessive alcohol consumption. If the client tests positive for illegal drugs or alcohol abuse, the case is exponentially harder and more expensive for the parent who tested positive for illegal drug use.
