Te Aka Matua o te Ture | Law Commission has released a Supplementary Issues Paper on Ngā Hunga Take Whaipānga me Ngā Pūtea Tautiringa | Class Actions and Litigation Funding and is now seeking public feedback. Submissions are open until 12 November 2021.

After considering the submissions we received on our 2020 Issues Paper we have confirmed our view that Aotearoa New Zealand should have a statutory class actions regime. The Supplementary Issues Paper seeks feedback on some detailed aspects of a class actions regime and includes draft legislative provisions on some topics.

As the 2020 Issues Paper contained a comprehensive discussion of litigation funding issues, it has not been necessary to develop supplementary chapters on litigation funding. However, some litigation funding issues are addressed where they overlap with the class action issues discussed.

As well as inviting submissions, we are hosting workshops to provide another way of giving feedback on our Supplementary Issues Paper. These workshops will be limited in size to allow participants to discuss the draft provisions and proposals.
