CFJ Action Alert – Voice of the Unborn Baby Court Case
BABIES GET THEIR DAY IN THE CONSTITUTIONAL COURT

Dear CFJ Supporter,

On 4 November 2021, Cause for Justice is going to the Constitutional Court to ask and answer this question: Do all human beings have inherent worth and dignity?

That is the question we believe lies at the heart of the Voice of the Unborn Baby case.

The purpose of today’s ACTION ALERT is to tell you more about this important court case and to ask for your support to enable our participation in the case.

What is the Voice of the Unborn Baby case about?

Current South African law regards babies who die before 26 weeks in the womb, as “medical waste”. This means these babies’ bodily remains are routinely and by default incinerated together with the remains of medical or surgical procedures (like removed organs and limbs, etc.). Tragically, grieving parents of such deceased babies are not legally allowed to receive their baby’s body or have a burial for their baby.
 
If the case succeeds, all parents will have the right to bury their baby’s bodily remains – and South African law will allow for the recognition of the humanity of all babies that die prematurely.
 
The High Court has provisionally ruled that parents of miscarried babies have the right to bury their baby’s remains, no matter how long (or short) a baby was in the womb. We celebrate this finding, but we cannot stop there. The High Court wants to deny this right from some parents, and instead wants to create a two-tier system: giving burial rights to parents whose unborn baby dies due to “natural causes”, while excluding parents of unborn babies who die as a result of human intervention (e.g. elective (on-demand) or non-elective abortion, because of medical complications during pregnancy).
 
We say, that is not fair – that is uncalled-for discrimination – and would result in an arbitrary denial of some prematurely deceased babies’ humanity.

Help us defend the inherent dignity of unborn human life

We want South Africa’s highest court to extend the right to bury to all parents – and to recognise the humanity of all babies. That is why we are going to the Constitutional Court, and we urgently need your help to get us there.
 
Cause for Justice has joined the case as a ‘friend of the court’ party. We are preparing to present evidence about the humanity of unborn babies and arguments to convince the Court to apply the constitutional value of human dignity to allow for the burial of unborn babies’ bodily remains.

Life issues - be a voice for the voiceless

You have a right to freely and without fear voice your convictions about the inherent worth and dignity of all human beings. This is why two incidents involving the harassment and assault of pro-life groups, for simply defending and speaking up for the value of human life, are very concerning.

The Life Chains event has been held in Cape Town for the past 30 years. But this year, it was disrupted by police. Members of SAPS told participants that they were not allowed to show their banner over a bridge. They were also told that they may not distribute any pro-life literature!


In the UK, a woman peacefully campaigning for the value of unborn human life, was assaulted by another woman who apparently did not agree with her views. The local police shrugged off the assaulted woman's complaint, telling her that offending someone was equivalent to punching them in the face. On top of this, they told the woman that she could likely be held liable for offending others.


In the USA, more than half a million Americans to date have signed a petition to overturn the Roe v Wade decision, the case which legalised abortion in the USA. We are encouraged that more and more people are speaking up for their belief that all human life has inherent worth and value.
