Hello from the Fair Team! As we approach the end of 2021 and prepare for the holidays, there may be some things to start to think about related to your helper. Fair has got a few tips for you in this month’s newsletter!

We hope you enjoy this issue of the Fair Bulletin. As always, if you have any questions, feel free to contact us!

Tip #1 Visa Extension

Have you checked your helpers visa expiry date recently? Keep track of when to get a visa extension to avoid overstaying. Remember, if a worker didn’t complete their home leave in the first year of the contract or if his/her passport will expire before the end of the 2-year contract, a visa extension will be needed. We recommend starting the visa extension process 2 months prior to the current visa expiry date. If you think you might forget, we would recommend putting a reminder in your calendar.  Read our guide on checking visa expiry date and applying for a visa extension. Fair Agency also offers visa extension service, feel free to contact us for details.

Tip #2 Managing Home Leave/Vacation

Existing travel restrictions make home leave/vacation nearly impossible for many workers and employers. Most employers and workers are deferring home leave/vacation.  If a worker and employer agree, the Immigration Departments is allowing workers to apply for an extension of stay visa, until the end of their contract, without taking home leave. This is different from standard policy. While a worker taking home leave may be very inconvenient, workers may have understandable reasons to return home. It’s essential to have an open conversation about each other's needs. After an arrangement has been agreed, we recommend signing a document outlining the home/vacation leave arrangement. To read more about it click here Home Leave.

Tip #3 Holiday Gifts or Annual Bonus

After another challenging year, many employers want to reward their domestic workers with a gift or bonus. We encourage employers to be clear about nature (Is it a gift or bonus?) and reason (performance, extra workload, appreciation). We also recommend being very clear if the worker can expect something similar in the future.  Managing expectations for the future leads to longer term employment situations and mutual gratitude and respect. Aside from cash bonuses, some employers give a small personal gift that shows they care. Thinking of gifts based on your helper’s interests and preferences is the perfect way to say ‘thank you’!

The Hiring Challenge lets employers explore ways to identify ethical agencies and how ethical hiring benefits all parties. Take #thehiringchallenge and see how you fare.

The Hiring Challenge

We are excited to be collaborating with Rights Exposure and International Labour Organization in their work to raise awareness amongst employers of the exploitation of migrant domestic workers in Hong Kong and providing them with tips on how they can contribute towards positive change.

'The Hiring Challenge' is an immersive web experience that casts the user in the role of a soon-to-be parent trying to hire a migrant domestic worker in Hong Kong using an employment agency. Take ‘The Hiring Challenge’ to explore ways to identify a professional agency and how ethical hiring benefits all parties: www.thehiringchallenge.org

Upcoming Statutory Holidays

Chinese Winter Solstice Festival or Christmas Day (at the option of the employer): 21 December or 25 December. A reminder that employers must give domestic helpers the day off even if they have been working for less than 3 months. Read more about statutory holidays here.
