No Ruling Released on the Emergency Temporary Standard

By Tony Stergio It was widely anticipated that the Supreme Court would make some type of interim ruling on the OSHA Emergency Temporary Standard (the Covid vax or test mandate) during today’s scheduled session. Per the Scotus Blog, that session has ended with no ruling being released on the OSHA ETS and therefore, remains in effect.

According to the agency, it is currently being enforced except for the weekly testing mandate which goes into effect on February 6, 2022. 

This means that all companies with over 100 employees should have:
  • COVID policies in place
  • confidential employee rosters regarding employee vaccination status
  • vaccination documents collected from all vaccinated employees
  • all unvaccinated employees masked when indoors (and not in a private office with the doors closed)
This, of course, is all subject to change if the Supreme Court issues an order to the contrary.  We will keep you posted.
