The ongoing legislation regarding prohibiting cannabis retail in Old Town will go before Land Use Planning and Zoning (LUPZ) at two hearings on March 16 and March 30, 2022 beginning at 5:00 p.m.
For the hearing on March 16th, “LUPZ is expected to hear a presentation, take public comments, and defer the case to a second hearing” (the hearing on March 30).
For the hearing on March 30, “LUPZ is expected to vote on proposed amendments to the Redline Draft [see the link below] and vote to recommend adoption, denial, or can pass it to the full City Council with no recommendation.”
“Please note: The proposed change to prohibit cannabis in the Old Town Historic Protection Overlay zone (HPO-5) is a small area text amendment. Changes proposed for regulations that would only affect a small area are considered quasi-judicial decisions - meaning City Councilors will be acting more like judges than like legislators. For this quasi-judicial decision only (not the other citywide legislative changes), discussions with Councilors are restricted to during public hearings, and people wanting to provide comments will be sworn in.”
