NMHCA/NMCAL Comments on Dementia Training
As you may be aware, the Dementia Training law that was passed during the 2021 Legislative Session went into effect on January 1, 2022, requiring facilities to have all staff trained within 60 days and providing new staff 60 days to receive the training.  NMHCA/NMCAL did not receive notification that the training was available until Wednesday, March 2, 2022, when Chris Burmeister told the assisted living providers on the monthly state-wide assisted living call that it was available on the state's TRAIN website.  On the same call, he promised to send that to the Association for distribution. On Tuesday, March 8, NMHCA received the final rule and access instructions, which we immediately sent out via the Bulletin for Members. 

NMHCA/NMCAL staff and other members have voiced serious concerns with the training program that was posted as well as statements made by the Division of Health Improvement that, according to the law, they would have to issue citations for facilities not in compliance. 

Members of the Regulatory Clinical Committee and NMHCA/NMCAL staff met with DHI on Thursday and expressed our concerns. They have asked us to submit our comments and concerns in writing so that they can elevate them through the appropriate channels. As part of our submission, NMHCA/NMCAL will request the rules be rewritten to reflect the intent of the law and to better target the audience and that citations not be issued for non-compliance until facilities have the opportunity to train staff. Given the difficulty and the length of the current training that is approved for use, we are requesting contact information from DHI for facilities to submit their own training programs for approval. NMHCA/NMCAL staff will also look at developing a more caregiver-friendly program that meets the intent of the law and incorporates the requirements from the current rules.

The required dementia training rules have been finalized and the training is now available on Train. Download the access instructions here. *Please note that this training is required for ALL long-term care facilities. 

 We have also located the PowerPoint slides on the US Department of Health and Human Services, Health Resources and Services Administration (HRSA) website, which is where the training was taken from. We strongly recommend you download them and use them to help your staff better understand some of the material. You can download the slides here. When you visit the site, please note that the required modules are 1, 4, 5, 6, 7, 9, 11, and 12.
