Bresky Law Obtains Reversal of a Post-judgment Order in a Paternity Proceeding

The order imputed a high income to our client (the father) and granted an upward modification of his child support obligation based on that imputed income. The Fourth DCA reversed the erroneous imputation of income to the father and the upward modification of child support. This favorable result for our client prevents him from being forced to pay an amount of child support that he cannot afford.

Bresky Law Wins Affirmance of Judgment on Attorney’s Fee Question

Bresky Law recently obtained affirmance of an attorney’s fee award against an insurance company, arising out of a car accident in which our clients sustained injuries. The ruling preserved the favorable final judgment awarding attorney’s fees and allows them to seek legal fees incurred for the appeal.

New Appellate Rule on Punitive Damages to Take Effect April 1

The Florida Supreme Court has approved an amendment to rule 9.130, which governs “Proceedings to Review Nonfinal and Specified Final Orders.” The amendment allows a party to seek interlocutory review of a trial court ruling on whether a party may amend its complaint to assert a claim for punitive damages.
