Bargaining Update - Member Attendance & Beyond

Dear Members,

There have been some members who have shown an interest in attending the Interest Arbitration hearing that your Union Executive is currently engaged in. We recently issued a bulletin outlining where we are in the cycle of bargaining and which process we are undertaking. You can find that bulletin 
HERE. We are grateful for the interest of our members and are pleased to see that they want to be involved and attend the arbitration hearing. We have worked through procedural issues this morning as the Union has advocated for the members to be in attendance. Arbitrator Vince Ready heard the submissions of both parties and has ordered that our members are not able to be in attendance. We will share his written decision with the membership once we receive a copy.
 
We were clearly hoping for a better outcome.  We want to assure everyone that your Bargaining Committee is fully invested in representing the membership at each and every turn of this process. We admit that it is frustrating to us that this is not a full round of open bargaining, however we are armed with excellent legal counsel, financial experts, CUPE National support and the wealth of knowledge, wisdom, and experience that your Bargaining Committee possesses.
 
Given the fact that we want to have a membership who is informed and educated, we thought this was a good opportunity to explain what Interest Arbitration is and the phase of this reopener that we are now in.
 
INTEREST ARBITRATION
Arbitration is a process in which a neutral third-party hears evidence presented by both the union and the employer on issues in dispute, and hands down a binding decision.  
 
In the context of these re-openers and the  Memorandum of Agreement negotiated in 2015, Interest Arbitration establishes new conditions within a collective agreement. 
 
In our Collective Agreement and the MOA governing this current round there are exceptions to items that may be included for Interest Arbitration.
 
Items which may NOT be included for Interest Arbitration are:  

  1. Annual Wage Increase;  
  2. Meal allowances;  
  3. Term of this Memorandum;  
  4. Article 2 in its entirety;  
  5. Pension– any aspects other than improvements to the existing defined contribution plan;  
  6. Job Security LOU in its entirety;  
  7. Flow Through LOU in its entirety; and  
  8. The duration of any of the collective agreements which will come into force pursuant to the Memorandum.  
 
A maximum of 10 items that remain in dispute can be moved to interest arbitration by the Union or the Company. 
 
COST NEUTRALITY AND EXCEPTIONS FOR ROUGE 
For both Mainline and Rouge, the arbitrator will consider several things when rendering a decision about a Permissible Interest Arbitration Item, including the total cost of the proposal and its impact on total compensation. The Arbitrator will not issue an award that increases the cost of Air Canada or Air Canada Rouge’s obligations. 
 
Exceptions to cost neutrality: 
However, the following Rouge items can result in an increase in cost based on a comparison with the terms and conditions of employment of other comparable employees at Air Canada Rouge, at other low-cost carriers, or in Canada generally, and/or cost of living: 
  1. Benefits; 
  2. Sick leave for Air Canada Rouge; 
  3. Credits, guarantees, and premiums for Air Canada Rouge Cabin Personnel; 
  4. Vacation for Air Canada Rouge; 
  5. Article 14 (Scheduling and Planning) and 15 (Duty Period Limitations) of the Rouge LOU; 
  6. Any other items that the Parties agree is of mutual benefit to them. 

 
We thank the members for their support during this time and encourage you to reach out if you have any questions about this process. Our hope is that we will make small gains during this reopener and the next and slowly build momentum and support from within the membership. When we achieve these goals and can bargain openly and fully in 2025, we will have a strong and cohesive bargaining unit.
 
Collectively, we will not rest until meaningful gains are made for the entire membership and your voices have been heard loud and clear.   Please stay tuned for new bulletins relating to a Bargaining Survey for the next reopener.  It is through this means that you can communicate your concerns and shortfalls that you find need improvement in our Collective Agreement. Our promise to you is that we will listen, learn and once again, move forward in the next reopener with a full understanding of what the membership needs.

Le point sur les négociations - Participation des membres et au-delà

Chers membres,

Certains membres ont manifesté le désir d'assister à l'audience d'arbitrage des intérêts dans laquelle votre exécutif syndical est actuellement engagé. Nous avons récemment publié un bulletin décrivant où nous en sommes dans le cycle de négociation et quel processus nous entreprenons. Vous pouvez trouver ce bulletin 
ICI. Nous sommes reconnaissants de l'intérêt de nos membres et nous sommes heureux de constater qu'ils veulent participer et assister à l'audience d'arbitrage. Nous avons examiné les questions de procédure ce matin, le syndicat ayant demandé que les membres soient présents.  L'arbitre Vince Ready a entendu les arguments des deux parties et a ordonné que nos membres ne puissent pas être présents. Nous ferons part de sa décision écrite aux membres dès que nous en aurons reçu une copie.
 
Nous espérions clairement un meilleur résultat.  Nous tenons à vous assurer que votre comité de négociation est pleinement investi dans la représentation des membres à chaque étape de ce processus. Nous admettons qu'il est frustrant pour nous qu'il ne s'agisse pas d'une ronde complète de négociations ouvertes, mais nous sommes armés d'un excellent conseiller juridique, d'experts financiers, du soutien du SCFP national et de la richesse de connaissances, de sagesse et d'expérience que possède votre comité de négociation.
 
Étant donné que nous voulons avoir des membres informés et éduqués, nous avons pensé que c'était une bonne occasion d'expliquer ce qu'est l'arbitrage d'intérêt et la phase de cette réouverture dans laquelle nous sommes maintenant.
 
ARBITRAGE D'INTÉRÊT
L'arbitrage est un processus dans lequel une tierce partie neutre entend les preuves présentées par le syndicat et l'employeur sur les questions en litige, et rend une décision contraignante. 
 
Dans le contexte de ces réouvertures et du protocole d'accord négocié en 2015, l'arbitrage d'intérêts établit de nouvelles conditions dans une convention collective.
 
Dans notre convention collective et dans le protocole d'accord régissant la présente ronde, il y a des exceptions aux éléments qui peuvent être inclus pour l'arbitrage d'intérêt.
 
Les éléments qui ne peuvent PAS être inclus pour l'arbitrage des intérêts sont : 

  1. L'augmentation annuelle des salaires ; 
  2. Indemnités de repas ; 
  3. Durée du présent protocole ; 
  4. L'article 2 dans son intégralité ; 
  5. Pension - tous les aspects autres que les améliorations apportées au régime à cotisations définies existant ; 
  6. Sécurité de l'emploi LOU dans son intégralité ; 
  7. La lettre d'intention sur les avantages indirects dans son intégralité ; et 
  8. La durée de toute convention collective qui entrera en vigueur en vertu du protocole d'accord. 
 
Un maximum de 10 points qui restent en litige peuvent être soumis à un arbitrage d'intérêt par le Syndicat ou la Compagnie.
 
NEUTRALITÉ DES COÛTS ET EXCEPTIONS POUR ROUGE
Tant pour le réseau principal que pour Rouge, l'arbitre tiendra compte de plusieurs éléments lorsqu'il rendra une décision sur un point d'arbitrage d'intérêt admissible, notamment le coût total de la proposition et son incidence sur la rémunération totale. L'arbitre ne rendra pas une décision qui augmente le coût des obligations d'Air Canada ou d'Air Canada Rouge.
 
Exceptions à la neutralité des coûts :
Toutefois, les éléments suivants de Rouge peuvent entraîner une augmentation du coût en fonction d'une comparaison avec les conditions d'emploi d'autres employés comparables chez Air Canada Rouge, chez d'autres transporteurs à bas prix ou au Canada en général, et/ou du coût de la vie :
  1. Avantages sociaux ;
  2. Congés de maladie pour Air Canada Rouge ;
  3. Crédits, garanties et primes pour le personnel de cabine d'Air Canada Rouge ;
  4. Vacances pour Air Canada Rouge ;
  5. L'article 14 (Horaire et planification) et l'article 15 (Limites des périodes de service) du protocole d'accord d'Air Canada Rouge ;
  6. Tout autre élément dont les parties conviennent qu'il est à leur avantage mutuel.

 
Nous remercions les membres de leur soutien pendant cette période et nous vous encourageons à nous contacter si vous avez des questions sur ce processus. Nous espérons que nous ferons de petits progrès au cours de cette réouverture et de la suivante et que nous créerons lentement un élan et un soutien au sein des membres. Lorsque nous aurons atteint ces objectifs et que nous pourrons négocier ouvertement et pleinement en 2025, nous aurons une unité de négociation forte et cohésive.
 
Collectivement, nous ne nous reposerons pas tant que des gains significatifs n'auront pas été obtenus pour l'ensemble des membres et que vos voix n'auront pas été entendues haut et fort.   Restez à l'affût des nouveaux bulletins relatifs à l'enquête sur les négociations lors de la prochaine réouverture.  C'est par ce biais que vous pourrez faire part de vos préoccupations et des lacunes qui, selon vous, doivent être comblées dans notre convention collective. Nous vous promettons d'écouter, d'apprendre et, encore une fois, d'aller de l'avant lors de la prochaine réouverture avec une compréhension complète des besoins des membres.
