Council adopts planning scheme amendments


Council at its Ordinary Meeting on Wednesday, April 13, 2022, has adopted the following amendments to the planning scheme and Planning Scheme Policy (PSP) – bushfire:
 
 Proposed amendment adopted  Purpose and general effect
 Major amendment 2
  • improve the planning scheme’s integration with the State Planning Policy (SPP)
  • improve the legibility and workability of assessment triggers, overall outcomes and development requirements to provide greater certainty
  • facilitate new development opportunities, like emerging industries, to ensure the region remains competitive
  • correct errors or reflect constructed development in the zoning maps.
 Administrative amendment 8
  • support the major amendment 2
  • create the consolidated version 4.0 of the planning scheme
  • update the administrative sections of the planning scheme.
 Administrative LGIP amendment 2  Make administrative corrections to the tables within
 the LGIP.
 Minor amendment 5
  • incorporate new or updated flood hazard mapping from adopted drainage studies
  • update overlay maps to reflect latest SPP mapping.
 PSP amendment 4   Update the PSP Bushfire to align with changes made in
 the Bushfire hazard overlay code (under major
 amendment 2).

All adopted amendments, except for Planning Scheme Policy (PSP) amendment 4, will be consolidated into a new version 4.0 of the planning scheme. Version 4.0 of the planning scheme and version 2.0 of PSP – bushfire will both commence on Tuesday, April 26, 2022.
 
New user guides will be made available when the new version of the planning scheme commences. The user guides cover bushfire hazard requirements, rural tourism uses and brewing or distilling alcohol.
 

Council makes a General exemption certificate for Local heritage places

 
Council has made a General exemption certificate for Local heritage places in accordance with section 75(3) of the Queensland Heritage Act 1992. The purpose of the General exemption certificate – Local heritage places is to support amendments made under Major amendment 2 to make all building work on local heritage places assessable development.
 
The General exemption certificate – Local heritage places exempts certain minor building works such as those that support ongoing maintenance and activities necessary to keep heritage places (identified by the planning scheme) in active use, good repair and optimal operational condition. No assessment against the Heritage and neighbourhood character overlay code is required for this work if carried out in accordance with the conditions of the document. The General Exemption Certificate – Local heritage places does not exempt any other type of development that may be triggered by the Mackay Region Planning Scheme 2017, Planning Regulation 2017 or the Building Act 1975.
 
The General Exemption Certificate – Local heritage places will commence on Tuesday, April 26, 2022.
