C@P exam completed

Good afternoon to every one, my question as follows after c@p exam completed how much long will it be to get answer will it take to get up or down? Does it usually take 6 months to get 100 percent temp disability for surgery? I had back surgery back in July and I am still waiting, yes it is service connected, Thanks Ken

VA Acquisition Regulation: Contractor Qualifications; Acquisition of Utility Services; and Contract Administration and Audit Services

The Department of Veterans Affairs (VA) is amending and updating its VA Acquisition Regulation (VAAR) in phased increments to revise or remove any policy superseded by changes in the Federal Acquisition Regulation (FAR), to remove procedural guidance internal to VA into the VA Acquisition Manual (VAAM), and to incorporate any new agency specific regulations or policies. These changes seek to streamline and align the VAAR with the FAR and remove outdated and duplicative requirements and reduce burden on contractors. The VAAM incorporates portions of the removed VAAR as well as other internal agency acquisition policy. VA will rewrite certain parts of the VAAR and VAAM, and as VAAR parts are rewritten, VA will publish them in the Federal Register. In particular, this rulemaking revises VAAR concerning Contractor Qualifications, Acquisition of Utility Services, and Contract Administration and Audit Services, and affected parts Definitions of Words and Terms and Solicitation Provisions and Contract Clauses. Frustrated!?!?

Is anyone else out there frustrated with this process? I mean crap, its getting old. I have been making inquiries about getting some help with secondary claims. Everyone I talk to say how thankful they are for my service then tells me they want an ass load of money to help me. I understand paying for a service but, $1500.00 for a freaking nexxus letter then half of what I get for a year. Christ Almighty. Being on my fixed income that is out of reach. Does anyone have any ideas on who I can talk to? I dont mind paying but it has to be within my means.

Secondary claim

How do I show that the failure of my right knee was caused by the injury I sustain to my left knee. I injured my left knee during a bridging accident in Bosnia in 2001. I had Surgery to fix the damage in 2002 at Fort Gordon. It was never the same and got worse causing me to put more weight on my right knee. In 2010 the VA sent me to have orthocopic surgery on both knees and they assigned a 10% rating to my left knee but nothing for the right knee. In 2018 the VA replaced both knees and assigned a final 30% rating for the left knee only. What options do I have as I was denied a secondary claim?

Sleep Apnea Secondary to PTSD

I filed a claim for Sleep Apnea secondary to my PTSD, which is service connected. I have been diagnosed from the VA as having sleep apnea, and given a CPAP to wear at night. I used Carpenter Chartered Law Firm to do the claim, but got this denial letter (attached is an excerpt). In it, it says "In the absence of other major risk factors such as obesity it would be reasonable to attribute OSA to PTSD as this is considered a risk factor for OSA from uptodate.com". My thought is that if both obesity and PTSD are considered risk factors, shouldn't it be a 50% chance that it could be either obesity or PTSD, and go to the veteran's favor? And doesn't that mean that attributing OSA to obesity is just as speculative as attributing it to my PTSD? I had Carpenter Chartered start an appeal, so I am hopeful to get it approved.

Upcomine C&P Exam for Nerve Damage due to surgery; What happens in that C&P?

Long story short. 🙂 My left knee is 30% Service connected. During the ACL surgery they nerves across the knee were severed and I have no feeling in the outside of my leg from the knee to the top of the foot/ankle area and around the front near the top of my foot. That area also no longer has hair. The inner muscle on my calf is significantly smaller than the other. I have an up and coming C&P exam with VES. I would like to know what all they do in this exam. Anyone have an idea? I don't think it falls under paralysis of the nerve as I still have function. I don't know if it falls under neuritis or neuralgia? Anyone have an idea?

How to get your questions answered on our VA Claims Forum. All folks who come here are volunteers who do this on their own time and their own dime. To avoid burning out our best contributors please follow these guidelines. You are reading a post and it reminds you of a question you want to ask, you should start a new topic, if you place your question in someone else's thread it will be difficult to distinguish your question from the original poster, you will get better results posting a new topic with your question. 1. Before Posting please do a Search and see if your question has already been answered. If you find the answer print it out and put it in a file to use as a reference file, I find this helpful myself. Another free tool I use is Evernote it has a free web clipper so any page you go to you can clip to a notebook for offline viewing. 2. If you can not find the answer and you do post a question, please print out those answers and refer to them to avoid duplicate questions. 3. Refer to the Frequently Asked Questions 4. Duplicate questions will come up from time to time but the keeping them to the minimum will lighten the load on the regular volunteers. 5. Respect folks privacy do not request their personal phone numbers for claims help, it is inappropriate and not why they are here. 6. Keep the topics focused on veterans issues, in closing Search first Search ... Ask second. it may save a lot of time or at the very least enlighten you.

Found random C&P exam

Not sure who might know this, possibly @brokensoldier244th, but would there be any reason for a C&P exam being performed (in my record), without me filing a claim during the time I had the exam? It appears favorable with exception to the examiner making a remark toward the end. I recall sitting down with someone from mental health during that time at the VA because I indicated my issues with mental health during my (presumptive from exiting active duty) left knee claim that was SC'd. I just find it odd that, even with diagnosis and favorable findings, it was never listed as a disability or NSC disability. I never even knew it existed until recently I can redact and post exam if needed. Thanks!

Increase Rating Questions

First off this is an amazing forum very helpful! Considering filing for increase in service connected hemorrhoids rated at 0%(that should be straight forward) I was diagnosed with plantar fasciitis a little over a year ago would I make that secondary to fallen arches? In addition having similar issues with right ankle years of limping starting to jack that up as well. I noticed that they apparently don't use the old Disability Benefits Questionnaires I had my doctors use the first time around. All of this is in my electronic records from each specialist I have seen. Do I need to have my doctors fill any other paperwork out or do i simply submit their electronic notes? Thanks in advance for any help. Current 80% (one 50%, one 20%, 7-10's)(Effective Date on all 2014) Bilateral Pes planus, claimed as fallen arches 10% left knee arthritis status post tib fib fracture 10% left ankle residuals, status post mid shaft tibia fib fracture 10% painful scar pst tib fib fracture 10% deep non lineal scar 10% kidney stones 20% Sleep Apnea 50% tinitus 10% skin condition 10% hemorrhoids 0% hemorrhoids (Service Connected rated at 0 now) Dr. Note states "PT has large permanent prolapse stage 4 causing considerable symptoms and need surgical treatment" (I haven't scheduled surgery yet as need to plan for 6 weeks off work) I know that if approved and I have surgery...this will have to be re-evaluated in the future. Plantar Fasciitis (Diagnosed in ER 2019....several doctors visits since...Podiatrist is in the process of doing molds on me for inserts to see if they help...but have used similar before with no affect. Any and all advise is appreciated!!

I reviewed my 21-8940 and it ask if you receive Disability Retirement Benefits. Is that the same as SSDI? I marked no in that box , but I sent a copy of my award letter with my TDIU packet. Should I file a NOD and submit that as new evidence or what route should I take? I'm sorry if I'm asking too many questions. I've learned a lot in these last 2 days from all of your comments. I should've joined earlier, but I'm technology illiterate. What forms do I use or should I go to a VSO. They weren't much before I got this far on my own. Thinking about an attorney, what do you know about Hill and Pontoon or any recommendations.

VA Denying Residential Substance Abuse Treatment During Pandemic

I am a veteran and so is my son. He is an honorably discharged veteran, but had a severe addiction to narcotics when he got out. During the pandemic, the VA shut down the residential treatment (DETOX) program and they REFUSE to refer veterans for treatment at facilities that are open, which are all facilities in the US EXCEPT the VA. He is stuck and I am watching him die slowly before my eyes. I have contacted our senator and congressmen, but they cannot get back to us for 7 days. I keep Narcan with me as there is a very real risk of him overdosing. His therapist says the best they can do is outpatient care, but he is FAR beyond that. I am at a loss of what to do next as I was under the false impression that if the VA cannot treat him, they must refer him out to a facility that can. Am I wrong? This is a service connected disability and he has an 80 percent rating. I would imagine there are MANY veterans being turned away from critical detox treatment during the pandemic. It is my opinion that it is very true that veterans die waiting for treatment and not much has change other than reshuffling the deck chairs on the Titanic of veterans care.

I checked my decision letter again and as I said before there is no mention of SSDI anywhere in the evidence section. I know that the VA had it because I sent the judge's ruling as a part of my packet. I appreciate all of your help, but I'm new at this. I've gotten myself this far but now I need assistance. I've got to look up all of the abbreviations you used to further understand. I have no way to scan my decision letter is there any other way? What is the difference between CUE and NOD, and do they both require new evidence?

Boot Camp Records of Injuries and Fatalities

I am trying to get records from 40+ years ago in support of my claim. Recently, I was advised to include "Boot Camp" events. There were several major events and at least one ended in the suicide of a recruit. It bothers me that I do not remember the names of these two recruits. I have contacted AFME (Armed Forces Medical Examiner), however, they did not come into existence until 1986, after the fact. I have also contacted Hq Marine Corps, no luck. I then contacted MCMA (Marine Corps Mortuary Affairs). MCMA is looking, however, because I do not have a name and it has been so long, they are supposedly going through a list of over 300 names. I have been looking through old newspaper articles, google searches, recently joined Together We Served, etc., etc., nothing so far. Why did I list all of this? I know how busy folks are and DO NOT want to take time away from anyone. Therefore, I wanted to list some of the avenues I have taken. I am not asking anybody to do the leg work. I have always been my own advocate. I really appreciate any advise. Perhaps there is something I have missed. Thank you, Drehne

Elimination of On-the-Job Training and Apprenticeship Trainee Certification

The Department of Veterans Affairs (VA) is amending its regulations that contain the requirements for certification of attendance at on-the-job training and apprenticeship programs. This final rule adopts without change a proposed rule implementing a section of the ``Veterans Apprenticeship and Labor Opportunity Reform Act'' (VALOR Act), which eliminated the requirement that veterans and other eligible persons certify attendance at an on-the-job or apprentice training program prior to disbursement of a training assistance allowance. This final rule also eliminates the certification requirement for trainees in a program of apprenticeship or on-the-job training under chapter 30 of title 38, United States Code. TDIU

I haven't worked since 2009 and was awarded SSDI in 2014. When I filed for TDIU I included my award letter from the SSA. There is no mention of SSDI or SSA in the evidence that the VA used to make their decision. I know they had it because I included it in my claims packet. The awards letter states vocational expert opinion and only include my service connected condition as the reason for me being granted SSDI. Should I see this in the evidence the VA used to make their decision?
