The Producer Responsibility Obligations (Packaging Waste) Amendment (Scotland) Regulations 2020

The Producer Responsibility Obligations (Packaging Waste) Amendment (Scotland) Regulations 2020

These Regulations were made on 18th November 2020 and will come into force on 1st January 2021, and although they only apply to Scotland, it’s best to understand how they may affect your organisation if they are applied in your region.  The changes relate to sections of the Environment Act 1995 and amend recovery and recycling obligations.

The 2007 Regulations stated that the producer was responsible for recovering and recycling a proportion of the packaging they produced, if that was more than 50 tonnes of packaging with a turnover of more than £2 million if;

  • The business manufactured raw materials for packaging
  • Converting materials into packaging
  • Filling packaging
  • Selling packaging to an end user
  • Leasing out packaging
  • Importing packaging or its materials into the UK

 

A target was set to meet the Government’s recycling targets.

The Climate Change Agreements, Regulations 2020

The Climate Change Agreements, Regulations 2020

This statutory instrument came into force on 1st October 2020.  It made amendments to the Climate Change Agreements (Administration) Regulations 2012 (S.I. 2012/1976) and the Climate Change Agreements (Eligible Facilities) Regulations 2012 (S.I. 2012/2999).  It provides a two year extension to the Climate Change Agreements Scheme, with the new target period extending the reduction rate for the Climate Change Levy to 31 March 2025.

The Climate Change Levy was introduced on 1st April 2001 and is a tax on fuels including natural gas, electricity, solid fuels and liquid petroleum when it is used by businesses and the public sector.

Flixborough Chemical Works Explosion

Flixborough Chemical Works Explosion

The Incident

Flixborough chemical works  had been managed safely for many years, with no notable accidents, until temporary repairs and modifications to maintain production were carried out after a six foot crack developed in one of the six inline reactors.  A proper engineering inspection and risk assessment were not carried out, and changes in the process were not reviewed before restarting the process.

On Saturday 1st June 1974, Flixborough chemical works was virtually demolished by a release of cyclohexane to the atmosphere and consequential explosion of warlike dimensions.
