Status Quo with H-1B Lottery
We previously reported a potential change to the H-1B lottery whereby wage would play a role in the selection process. We are pleased to advise that USCIS published a final rule yesterday delaying the effective date of this rule to December 31, 2021. This means that, at least for this year's H-1B cap season, wage will not be considered in the selection process and it will be completely random as in previous years.
USCIS also announced that the H-1B lottery period will be slightly different this year: March 9 - March 25. Companies will be able to electronically submit entries anytime during that period.
