Situation of human rights defenders and activists in Egypt

Sudanese refugees before military court

On 15 February 2021, the Egyptian Public Prosecution referred the case of 10 Sudanese refugees to the Emergency State Security Misdemeanour Court (military court). This is the first time that a refugee case has been referred to this court, under anti-terrorism law. This case relates to protests following the killing of a 12-year-old Sudanese child on 29 October 2020, when the 10 Sudanese refugees were arbitrarily arrested by Egyptian security forces while peacefully demonstrating. They were detained for almost three weeks without access to a lawyer and eventually released on 20 November 2020 on a bail of 2,000 Egyptian pounds each.

TRIALS AND INVESTIGATIONS

Detention renewal of human rights lawyer Mahienour al-Masry and journalists Solafa Magdy and Esraa Abdel Fattah

 
On 2 March, Cairo Criminal Court renewed the detention of human rights lawyer Mahienour al-Masry and journalists Solafa Magdy and Esraa Abdel Fattah in case 488/2019 in which they are facing charges of participating in a terrorist group, misusing social media and publishing false news and information.

Mahienour al-Masry, Solafa Magdy and Esraa Abdel Fattah all filled complaints to the Court regarding their detention conditions. Mahienour al-Masry and Esraa Abdel Fattah reported that the Qanater prison administration had stripped them of all of their belongings, such as clothes and blankets, including personal belongings. Solafa Magdy reported being physically assaulted and having her health condition degrading.

Detention renewal of rights lawyers Amr Nohan & Haitham Mohamedeen
 
On 2 March, Cairo Criminal Court renewed the detention of human rights lawyers Amr Nohan and Haitham Mohamedeen for 45 days in case 741/2019 in which they face charges of participating in a terrorist group, misusing of social media and publishing false news and information.

Haitham Mohamedeen is a labour rights lawyer and left-wing activist. He participated in several protests against the Sisi regime, including in 2016 following the transfer of the Red Sea islands of Tiran and Sanafir to Saudi Arabia and in 2018 against the increase in the price of metro tickets. He has been held in pre-trial detention since 13 May 2019.

Detention renewal of human rights lawyer Hoda Abdel Moneim


On 1 March, Cairo Criminal Court renewed the detention order of lawyer Hoda Abdel Moneim for 45 days. She is investigated in case 1552/2018 in which she faces charges of joining and funding a terrorist organisation and incitement to harm the national economy.

Hoda Abdel Moneim is a human rights lawyer who works on documenting human rights abuses, including incidents of enforced disappearance. She formerly served on Egypt’s National Council for Human Rights in 2012-2013. Ms Abdel Moneim was also a spokesperson for the Women’s Revolutionary Coalition of Egypt, which opposed to the removal of former President Mohamed Morsi in 2013.

Detention renewal of human rights lawyer Mohamed al-Baqer & blogger Alaa Abdel Fattah


On 1 March, Cairo Criminal Court renewed the detention of human rights lawyer Mohamed al-Baqer, and blogger and human rights activist Alaa Abdel-Fattah for 45 days in case 1356/2019 in which they face charges of joining a terrorist group, committing a funding crime, and publishing false news and information. On 2 March, Alaa Abdel-Fattah expressed his desire to be brought before the court to have a chance to respond to the charges against him.

Alaa Abdel Fattah is an Egyptian activist, blogger and software engineer who has been at the forefront of the struggle for change in Egypt for many years. He has the distinction of having been arrested not only during Mubarak's rule but also by the different regimes that have ruled Egypt since the 2011 revolution. His sister Sanaa Seif is currently held in pre-trial detention after she tried to visit him in June 2020.

Mohamed el-Baqer is a human rights lawyer and director of Adalah Center for Rights and Freedoms.

Detention renewal of Dr Abdel Moneim Abul-Fotouh


On 22 February, Cairo Criminal Court renewed the detention of Dr Abdel Moneim Abul-Fotouh for 45 days in case 440/2018, in which he faces charges of establishing and leading a terrorist group and publishing false news and information.

Dr Abdel Moneim Abul-Fotouh is the head of the Strong Egypt Party and ran as an independent candidate for presidency in 2012. He is known for his strong opposition to the Sadat and Mubarak regimes. He was a member of the Muslim Brotherhood until 2011. He was arrested on 16 February 2018 and is being held in Tora prison.

Precautionary measures for journalist Shimaa Samy


On 22 February, Cairo Criminal Court extended the precautionary measures against journalist Shimaa Samy for 45 days in case 535/2020, in which she faces charges of participating in a terrorist group, misusing social media and publishing false news and information. She is also held in pre-trial detention in case 65/2021, in which she faces similar charges.

Detention of human rights lawyer Mohab el-Ebrashy renewed


On 22 February, Cairo Criminal Court renewed the detention of human rights lawyer Mohab el-Ebrashy for 45 days in case 1898/2019, in which he is charged with joining a terrorist group.

Detention renewal of human rights defender Mohamed Adel


On 22 February, Mansoura Prosecution renewed the detention of human rights defender Mohamed Adel for 15 days in case 4118/2018, in which he is facing charges of joining a terrorist group and publishing false news.

Mohamed Adel is a human rights activist and is one of the founders of the April 6 youth movement in Egypt. He has been detained since June 2018. On 22 February he started a hunger strike to protest the Prosecutor's decision to renew his detention in the absence of his lawyers.

Detention renewal of blogger Mohamed Oxygen & activist Sameh Seoudi


On 19 February, the Supreme State Security Prosecution renewed the detention of blogger Mohamed Ibrahim Radwan (known as Mohamed Oxygen) and activist Sameh Seoudi for 15 days without them being brought before the prosecution. They are investigated in case 855/2020 in which they face the charge of joining a terrorist group.

Mohamed Oxygen, was first arrested on 6 April 2018, is an Egyptian blogger and employee in a publishing house who, in addition to his blog, runs a Facebook page and a Youtube channel called Oxygen Egypt where he publishes reports on human rights issues and interviews with human rights activists, opposition figures and public personalities.

Detention renewal of human rights lawyer Amr Imam & journalists Hossam al-Sayyad and Ahmed Shaker


On 16 February, Cairo Criminal Court renewed the detention of human rights lawyer Amr Imam and journalists Hossam al-Sayyad and Ahmed Shaker for 45 days in case 488/2019, in which they face charges of participating in a terrorist group, misusing social media and publishing false news and information.

Amr Imam is a human rights lawyer with the Arabic Network for Human Rights Information.

Detention renewal of journalists Hesham Fouad & Hossam Moanes

On 15 February, Cairo Criminal Court renewed the detention of journalists Hossam Moanes and Hesham Fouad for 45 days in case 930/2019 in which they face charges of terrorism and publishing false news and information.

The crackdown of the Egyptian authorities on civil society organisations, journalists, and political dissidents has dramatically worsened since the military seized power in July 2013.
