I, being of age 18 and over, as a condition of participation in the Miss Showgirl USA Competition (“Activities”), and in consideration of being permitted to participate in all Activities sponsored by, scheduled for, run and/or operated by Cleo The Hurricane, LLC., WAIVE, RELEASE, and DISCHARGE Cleo The Hurricane, LLC., and its officers, instructors, judges, directors, agents, employees and shareholders, and its affiliated companies, partners and associates, and their officers, directors, managers, members, agents, employees and shareholders (collectively, the “Releasees”), from any and all claims and/or liabilities for or by reason of any cost, expense, damage, loss or injury to person and property (collectively, the “Damages”), even injury resulting in my death, which has been or may be sustained in consequence of participation in pole dance, roller skating, floor work, and/or other activities (collectively, the “Activities”), and notwithstanding that Damages may have been caused solely or partly by the negligence of the Releasee. I understand that the Activities may involve a high level of both physical and emotional exertion by me, and as such, my participation in the Activities involves inherent risks and may result in accident or injury. I recognize that such physical activity and exertion may be difficult and strenuous and may cause or aggravate a physical injury or medical condition that I may have. I am fully aware of and accept all the risks and hazards involved.
I understand that it is my responsibility to consult a physician prior to and regarding my participation in the Activities. I represent and warrant that I am physically fit and able to participate and have no medical conditions that would be aggravated by the Activities, and that I have no medical condition that would prevent my full participation. I hereby acknowledge and agree that I have carefully read this Waiver and Release agreement, that I fully understand it, and that I am freely and voluntarily executing it. By signing this release I will be forever prevented from suing or otherwise claiming against any Releasee for any property loss or personal injury that I may sustain while participating in or preparing for the Activities. I hereby waive any and all claims or actions I may now or in the future have and release from all liability and agree not to sue any Releasee for any Damages, including but not limited to Damages from personal injury, death, or property damage incurred or suffered by me, as a result of my participation in any Activity. I understand that I would not be permitted to participate in the Activities unless I have signed this agreement.
I authorize Cleo The Hurricane, LLC. to use photographs, recordings and/or videotapes of me (“Images & Recordings”) for purposes of advertising, marketing, promotion, operation and administration during the Activities. I grant to Cleo The Hurricane, LLC. the irrevocable and perpetual right and license, with no further consideration or remuneration to me, to use still photographs, likenesses, video, recordings and other media related to the Images & Recordings in and in connection with present and future advertising, marketing, promotion, operational and administrative efforts of Cleo The Hurricane, LLC., including use of such media on Cleo The Hurricane, LLC.’s website(s), social media (including Google and Yelp), telephone systems, newsletters and otherwise in the course of its business, or to refrain therefrom in whole or in part. You grant Cleo The Hurricane, LLC. the right to edit, alter and create derivative works of the Images & Recordings as Cleo The Hurricane, LLC. may choose in its sole discretion, and to reproduce the Images & Recordings in any format or media.
The registration, and or membership fees paid herewith, and such registration, and or membership fees paid hereafter, are non-refundable, unless otherwise determined in the sole discretion of Cleo The Hurricane, LLC. I also understand that will have no rights or claims against Cleo The Hurricane, LLC. or its agents or employees, or the owner of the premises at which Cleo The Hurricane, LLC. may operate, by reason of refusal to allow me to participate in the Activities. Cleo The Hurricane, LLC. reserves the right to refuse service to anyone for any reason at any time (except as otherwise provided by applicable law). I understand that this agreement is binding on me, my spouse, my heirs, my executors, administrators, personal representatives, my assigns, and, if I am under the age of 18, my parents and/or guardians. This release contains the entire agreement between the parties to this release and the terms of this release are contractual and not to a mere recital. I (and my parent(s)/ guardian(s), if applicable) agree if any claim for participant’s personal injury or wrongful death is commenced against Releasees, I shall indemnify and save harmless Releasees from any and all claims or causes of action by whomever or wherever made or presented for my personal injuries, property damage or wrongful death. This Waiver and Release Agreement will be construed in accordance with and governed by the laws of the State of California, and it is agreed to be as broad and inclusive as permitted by the laws of this jurisdiction.
I HAVE READ AND UNDERSTAND THIS AGREEMENT, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST Cleo The Hurricane, LLC.
