Meteorologist Patrick Evans of KESQ will host our Bunny Basket Bonanza fundraiser, wherein he will auction off baskets one at a time, filled with gifts, in an attempt to raise money for the Cathedral City Boys & Girls Club.

Past Presidents will Convene Biannually at PSRAR'S Presidents Council!

’Hey Gang, so I made a motion, which was carried, at the January PSRAR® Board of Director's meeting to form a 'Presidents Council' consisting of all active, primary PSRAR® Past Presidents. The current President will always serve as the Council Chairperson, and meetings will be held biannually. In 2021 the meetings are slated for March 31st and September 30th, and the goal is to allow the Past Presidents to weigh in on the Association's current State of Affairs. As past leaders, their spheres of influence are vast, and listening to their input firsthand may provide sage advice to the current leadership team. To the best of my knowledge, among our esteemed Past Presidents who will serve on the 2021 Presidents Council are Karen Joy Tabbah, David Cantwell, Jim Franklin, Scott Lyle, Becky Bowles, Dwayne Carrier, Mary Ellen Hill, Jim Webb, Kevin Stern and John Burge. Have a terrific week, and I’ll see you at the Caravan Meeting tomorrow at 9AM!

NEW CA LAW EFFECTIVE JANUARY 1ST, 2021

I received an email from a member asking me about rental restrictions in CID’s...(Common Interest Developments), that includes anything with an HOA. AB 31-82 in civil code 4740, 4741 California Law has been passed and is effective as of 1/1/2021. It prohibits CIDs from having unreasonable rental restrictions...in a nutshell, unreasonable is considered anything more than 30 days. That means that the CC&Rs in some associations need to be changed to comply with the new law. Example: At Sundial, where I live, (a PUD...Planned

Unit Development) the rule was that any rental had to be for 6 months or more...that has to be changed to 30 days or one month. Most likely an Association will need to have a vote of the homeowners to change this rule in the CC&R’s document unless the Board of Directors has in their By-Laws the ability to automatically make changes according to the law. Next week I will be writing about ADU/JADU in Planned Unit Developments, another recent change in the law. You can find this legal change in Civil Code 4751. This new law is not applicable to condos. Do you know how to tell a condo from a PUD? Answer: If the legal description says Lot # it is a PUD. Sundial is a PUD and as such, you are able to obtain FHA financing.

The Vote Is In!

Measure B passes in Cathedral City! As of Thursday, the count was 4465 in favor of Measure B and 2457 against Measure B. While there are still votes to count, it is almost impossible for Measure B to fail at this point. Measure B will allow the City to enforce Ordinance 842 that bans (ok, in the words of the ordinance “Does not Allow”) rentals of fewer than 28 days in R-1 residential areas, mainly Single-Family Residences. Current STR permitted properties can still do short term rentals until 2023, so for about 2 additional years. It does allow STRs in HOAs that allow it and “home shares” where someone representing the homeowner is there at all times during the rental. This ordinance can be changed at any time by a 3-2 vote of the City Council and does not require a vote by the citizens of Cathedral City. For example, once the Ordinance is effective, the next day the council could vote to ban STRs in an HOA. How does this affect Realtors? For one, a potential buyer should be informed of this restriction on their property before they begin a search in Cathedral City. In addition, there will probably be several hundred properties that come on the market over the next 2 years, as the owners cannot afford to maintain the property without the additional income. While prices probably won’t change much, the number of sales should show a slight increase.

More sales equals more income for us. What happens if a homeowner rents the property short-term anyhow? They could be fined as much as $5.000.00 per day if they operate without a permit, which will not be available. The City will now have to have an enforcement program to track down violators and fine them. Failure to pay the fine could become a lien on the property, affecting a future sale. Where was PSRAR in this? We supported the “No on B” group to protect the property rights of the homeowners. The owners should have the right to rent the property to whomever they want, whenever they want and for any length of time they want. CATAPULT’S SPRING SEMESTER BEGINS APRIL 7, 2021

The first winter semester of Catapult has been completed and the reviews are in!  “Very enjoyable.”  “Educational.”  “I always take away so much information.”   “It was very informative and presented very well!”  “Robert gives us a clear and comprehensive understanding to all of the elements of the forms and subject matter being discussed.  He welcomes and encourages all participation.  Robert is also available before and after the training for any follow-up questions and/or solutions!  Good job!”

Catapult is for new licensees, seasoned agent updates, or for anyone needing just a plain old kick in the pants!   Look out for the Spring semester of Catapult beginning April 7, 2021.  Based on the feedback and suggestions of our participants, some modifications are being made to enhance the content and your experience!
