Ban on Deferred Sales Charges

The Ontario Securities Commission (OSC) is moving to ban deferred sales charges (DSC) on mutual funds in Ontario. Under the rule, the payment of upfront sales commissions by fund organizations to dealers will be prohibited, harmonizing the DSC ban across Canada.

The payment of upfront sales commissions to dealers gives them an incentive to sell mutual funds that impose redemption fees on investors if they sell their holdings before a certain time period. Learn more

CIPF provides limited protection for property held by a CIPF member firm on behalf of an eligible client, if the firm becomes insolvent. CIPF's mandate was established by Canada's provincial and territorial securities regulators, including the OSC.

Proposed Amendments to NI 14-101 Definitions and Consequential Amendments

The CSA are proposing amendments related to a uniform definition of "Canadian financial institution" and a revised definition of "Handbook." Learn more

Comments due: July 28, 2021

Canadian securities regulators, including the OSC, proposed a framework for the designation and regulation of commodity benchmarks and the persons or companies that administer them. Learn more

 

Proposed Amendments to OSC Rule 25-501 & Proposed Changes to Companion Policy 25-501

Comments due: July 28, 2021

The OSC published a separate notice of proposed amendments to OSC Rule 25-501 and the CP regarding commodity benchmarks.

OSC Rule 25-501 is based on, and consistent with, Multilateral Instrument 25-102 Designated  Benchmarks  and  Benchmark  Administrators (MI 25-102) of the Canadian Securities Administrators (CSA). Investment Scam involving Fidelity Investments

The Canadian Securities Administrators (CSA) is warning the public about an investment scam claiming to represent Fidelity Investments.

The scam provides investors with documents outlining two investment opportunities that purportedly offer a guaranteed and high rate of return on the investments. The “Fidelity Capital Protected Fixed Income Fund” and the “Guaranteed Investment Bond” are not products offered by Fidelity Investments. Learn more

Sunil Tulsiani

The OSC is warning Ontario investors regarding the conduct of Sunil Tulsiani, who is permanently banned from trading securities in Ontario, and pleaded guilty to Securities Act offences in 2017. The OSC is aware of events being hosted by Mr. Tulsiani’s Private Investment Club. Learn more

COVID-19 Fraud Alerts

Watch our COVID-19 fraud alert video series. Fraudsters are exploiting the fear surrounding economic conditions and the COVID-19 pandemic.

Fake government messages. Be careful of fraudsters posing as government agencies or departments by text or email.

Financial representative impostors. Be on alert for fraudsters posing as your bank or investment firm advisor.

Quick High-Return Schemes. Fraudsters are targeting people experiencing financial hardship from COVID-19 with quick high-return schemes based outside of Canada.

Pump-and-dump scams. This is a type of investment fraud where fraudsters artificially increase the price of a stock that they own by encouraging other investors to buy it. 

Work from home scams. Be on alert for fraudsters offering fake job opportunities.

OSC in the Community

OSC in the Community is an outreach program that takes the OSC's regulatory mandate from Bay Street to Main Street. OSC staff travel to communities across Ontario to talk to people about making informed financial decisions and avoiding investment fraud.

To protect the health and safety of the public and staff, all OSC in the Community events will be delivered online or by phone until further notice. We will continue to monitor the situation and follow guidance from public health authorities.
