Penalty Prevention: Form I-9 Update & Remote Employee Verification


Deadlines to Start Using New Form I-9

Starting on November 1, 2023, employers are required to use the revised Form I-9, Employment Eligibility Verification, dated 08/01/23 for employment eligibility verification. This updated form allows eligible employers to remotely verify employment eligibility. Prior versions of the form will no longer be accepted after November 1, and non-compliance may lead to penalties. These changes aim to enhance the customer experience, and further initiatives are under consideration.

I-9 Simplified: Remote Document Verification

As of July 21, 2023, Employers enrolled in E-verify can remotely examine their employees' identity and employment authorization documents using the process detailed in Section 4.5 of the Handbook for Employers (M-274). When documents are verified remotely, a specific box on Form I-9 must be checked. Additional information and FAQs can be found in the Federal Register under "Optional Alternative 1 to the Physical Document Examination Associated With Employment Eligibility Verification (Form I-9)."
